If Martial Law is declared, what happens to our guns?

I voted early, too much at stake right now. Wish we had fewer incumbent politicians though. Inflation, Oil Prices, Energy Policy, legal system, free speech, immigration, and possible nuclear war. What I really hate is how little info is available on Judges.

I agree, I never know if I’m voting for a jerk or not.
But I suspect that if they ā€œcampaignedā€ for judicial positions, it wouldn’t help me. Other political campaigns certainly don’t tell me anything I need to know. And the average voter is unlikely to understand the judicial system well enough to know whether a judge is effective or not.
I’ve come to the point where I generally just skip that part of the ballot. Maybe that makes me a bad voter, but I’d rather admit my own ignorance than vote in spite of it.

After almost 40 years in and around the military, I am convinced that the military will not obey an order to confiscate guns.
The second problem is that there is no list of gun owners for the government to attack.

There isn’t? CC permits/licenses, Forms 4473, gun store records, plenty of ways to find us, including this site.

If I don’t know, I vote no on reelection if there is a republican in office.

Yeah it would be helpful if we were able to look up the Judge and past cases. That would take a long time though.
Fortunately I received a voter guide that did have some information on each judge about how others felt about them (other judges, lawyers, jurors) that did prove helpful.

I don’t have a voter guide to my county judges, but that would be helpful.
I’m not sure if it would be helpful to see the judge’s cases. As we see in the news, the way a case is reported can be wildly different from the way the case proceeded in court. Sometimes, just one or two missing facts from the story can greatly alter the way the case is perceived. It also doesn’t take into account the attorneys that a judge has to deal with. If the prosecution blows a case, for example, it isn’t the role of the judge to fix it and make sure the suspect is found guilty, anyway.

Every time I hear Plea Deal, Repeat offender etc. I remember. I vote no to all judges, this cycle there were probable a dozen or so on the ballot. The fact of the matter is, I very very seldom hear of a judge released due to voters voting to not retain them.

Yeah, but again, that’s not necessarily the judge, right? If the prosecutor and defense attorney agree to a plea deal and present it to the judge, how often is that judge supposed to reject it? The prosecutor represents the county or state, so if the county is willing to agree to terms, it seems like it would be rare for a county judge to reject those same terms.

Ditto for repeat offenders. It could be the fault of a judge for light sentencing or something similar, but it could also be the fault of a prosecutor, or perhaps even the police if they mishandled an investigation. The rules purposely favor the defendant, in most cases, so if there’s a problem with the case, a perp could walk. That’s the way the system is designed, and it’s not necessarily the fault of the judge.

One thing I might be interested in is the number of times a judge’s decisions have been overturned or handed back from a higher court. That could indicate incompetence. But even with that situation, I couldn’t be 100% sure. Some appellate courts don’t have the best track record, either.

It’s a tricky thing for voters to sort out, that’s all I’m saying.

Agreed, we have a pretty complex sentencing matrix here in Utah so I assume on many occasions the judge has he his hands tied. As far as plea deals go, I didn’t stay at Holiday Inn Express, I think they all have to be approved by the case judge, I may be mistaken. All of that said, the lack of readily available records and information on sitting judges has to make one wonder.

It’s amazing how many things are illegal, yet done anyway.

It is a violation of the law to use those sources to identify gun owners. It would require a massive invasion of our privacy and property rights to use those.
I agree that if there was a national declaration of martial law, all this goes out the window, but I contend that such a declaration would not be obeyed.
Just my opinion.

I wish I was so hopeful. Since the government agencies have already shown that they will NOT follow the law, I see no evidence that they will NOT trample over every other right and norm that we might have been used to. I’d love to be proven wrong.

We can only hope so…

First thoughts, if the military shows up, providing they are following such orders, simply ask, are you keeping to your oath or breaking your oath?

In a martial law scenario, it all boils down to this:
Are they willing to die trying to take your guns and supplies?
Are you willing to kill to keep them?
As a subheading from above, are you willing to live like an insurgent after you kill to keep your guns?

Boil it down even further, and it comes down to who wants to stack-up in the ā€œfatal funnelā€ going into a structure owned by an armed defender (who is likely armored as well) who has had the benefit of time to prepare and arrange defenses?

U.S. Army doctrine tells us that when assaulting a fortified enemy, it takes a minimum of three attackers per each defender to have a decent chance at success. Apply tactical/strategic concepts to your home: Observation, Cover & Concealment, Obstacles, Key Terrain, and Avenues of Approach. That makes it harder for the aggressors.

I’ve it said before, I’m closer to the end than the beginning. Not much you can take from me. BUT for my kids, in their 30’s and my grandbabies, 0-5 years old. Yep I’m willing to fight for a Free Future for them.
