I hope this fits in with this topic; so if martial law is declared does our 2A right still apply?
A self-declared online legal expert* could probably make a good argument that the 2nd Amendment is written in such a way that it cannot be suspended even under martial law. But that’s kind of like saying gun-free zones will keep us safe from people with guns. Laws, in and of themselves, don’t protect us.
Martial Law can be paired with a suspension of habeas corpus, allowed by the Constitution in extreme circumstances. So if you were in a martial law zone (keeping in mind that these are local and temporary), don’t expect a lot of legal protections for your firearms. Best case, you could get some legal relief once martial law is lifted.
Again, though, if you were a high-ranking officer put in charge of an emergency situation, would you dedicate your over-worked and under-paid people to walk around and collect firearms? Or would you be more focused on the emergency at hand so you could go home?
