I’ll be heading to upstate NY in the near future. The Reciprocity map says it’s legal to own a Byrna (Kinetic only) in Upstate New York barring local ordinances. Is it legal to carry it as someone from out of state who wouldn’t have any New York licenses?

I asked Siri who pointed out several sources. NY State does not consider them a firearm but NY City does.
Legality of Byrna in New York State
General Overview
In New York State, the possession of a Byrna is generally legal outside of specific restricted areas. The Byrna is classified as a non-lethal device that uses CO₂ to launch projectiles, which means it is not categorized as a firearm under state law.
Restrictions in New York City
| Location | Legality of Byrna |
|---|---|
| New York State | Generally legal |
| New York City | Banned |
In New York City, however, the situation is different. The city has strict regulations that prohibit the possession of Byrna devices, along with other similar non-lethal weapons. This means that while you may legally own a Byrna in other parts of the state, carrying it in New York City can lead to arrest.
Important Considerations
- Local Regulations: Always check local laws before carrying a Byrna, as regulations can vary significantly between different areas.
- Restricted Areas: Be aware of specific locations where carrying any weapon, including Byrna devices, may be prohibited, such as government buildings and parks.
Understanding these legal nuances is crucial for anyone considering carrying a Byrna in New York.
