Delaware Permit to Purchase law

Delaware recently implemented a Permit to Purchase Law - Extremely disappointing

I started getting into Firearms late in my life -near retirement - as a hopy I like learning and going to the range to shoot - I dont have a CCW - It is a hobby even though I liked the idea of a CCW the challenges of aquring one didnt make sense and not worth the effort - Again enjoy buying guns and go shooting at a range. Note I am not a hunter either - Bottom line I enjoy collecting and learning about each gun/Rifle I bought I have maybe 7

Well bottom line I refused to go through the proccess of of permit to purchase - it doesnt make sense for 2 year permit - Even though my purchases have all been in the last 6 years- Unfortunealy who is going to suffer are the business who sell gun and the delays you have to go just to buy one - Not many people can afford the process I just dont understand and not accepting the rules I just wont buy any

Welcome back to the forum, David.

Unfortunately, some politicians and judges have a hard time understanding the simplest of words: “shall not be infringed.”

It’s as fundamental a right as speech, worship and free association, and it’s necessary in order for us to exercise our inalienable rights to life, liberty and the pursuit of happiness, and to the security of a free state, but somehow that all gets missed.

Good luck with getting the laws in your state corrected, or consider relocating to a state that still knows how to read the Constitution.

Just remember, you deserve whatever abuse you choose to tolerate.

Moving out of Delaware is an option for you, but finding a group that is willing to fight this unconstitutional law is better.

Thank you enjoying coming back to the community- moving at this time is not an option and if the laws changed here it is possible it can change wherever

We have 2 formidable advocates fighting this but the fact is once it is law it’s very hard to change and the efforts where denied by a judge so the issue and results are the same we are slowly being stripped of our rights - and it’s disappointing

Colorados permit to purchase law hasn’t gone into effect yet, none the less it forced my hand into 3 firearms purchases including a Barrett M107!

Law probably won’t pass constitutional muster under the Bruen decision.

Unfortunately, that still means someone has to fight it.

In the meantime, enlightened governors like DeSantis here in Florida are giving a sales tax holiday on all guns and ammo, to help Floridians exercise our constitutional rights, even those for whom affordability is an issue. God bless him.

It’s like we all live in separate countries.

Edit to add, by the way, it appears Florida lands squarely in the middle of the bell curve for murder rate, at 24th in the nation, further proving that gun control laws do nothing to prevent murder. It’s ridiculous. Nothing will change until enough people in these blue states wake up to the fact that criminals don’t obey gun laws, and they’re only hurting themselves by supporting gun grabbing politicians.

Does it apply to both new and used firearms?

Colorados is any semiautomatic over .22 rimfire caliber.

That is exactly my point it doesn’t prevent anything other than legal abiding citizens I am not sure why we are not using and bringing

those analysis to the table

It doesn’t pass muster, and you know that.

I’ve contacted lawyers about Colorados permit to purchase law,…

Until it goes into effect and actually causes harm to otherwise legal gun purchasers it can’t be contested.

It’s almost like that’s why I said it.

That is the reason for the law. When it gets time-consuming, expensive, and Byzantine, most people won’t bother to go through the process. These laws don’t prevent those that skirt the laws from obtaining firearms, only the law-abiding. Forget to dot an i and face the expense of defending yourself in court, possible jail or prison time, etc., keeps the law-abiding in check, while it denies their rights. The politicians can claim that it does not prevent one from legally obtaining firearms, and that only those that have something to hide - criminal history or some other disqualifier - will not go thhrough the process, while knowing that is not true, for the prior stated reasons.

My state is going to suffer through the next 4 years of another Democratic governor, and at least two years of both houses of our legislators being in full control by the Democrats, who rarely find a bad law they don’t like.

:man_facepalming: Another unfortunate strike against law-abiding citizens Right to Bear Arms, and these unconstitutional laws DON’T STOP CRIMINALS NOR THEIR CRIMES USING ILLEGALLY POSSESSION OF FIREARMS which ARE NOT being addressed. CRIME JUST GOES ON!!! It’s another political angle to discourage law-abiding citizens from purchasing firearms (hit them in their pockets) heading towards total disarmament and slowly putting gun shops out of business since these laws are putting to many harsh restrictions for firearms to be purchased. Laws like CANCER eating away at our 2nd Amendment slowly until it’s ALL gone.

No only for new purchases not sure yet how that will work out for already purchased guns my concern iOS what will they keep adding to it

And that’s how the liberal states like it. Unfortunately there are not enough of people who care in your state. So it’ll only get worse until it’s challenged in court and won. The easier option for many is to do like many of the big companies are doing….. Leave for somewhere more friendlier. I left Louisiana and now live in Mississippi and couldn’t be happier.

Welcome to the community! Yes, it’s a big shame that law-abiding citizens have to get a (mommy may I) permission slip to purchase our ADULT TOYS, AND in ADDITION a (mommy may I) permission slip to conceal carry , BUT OH NO!!! Not for FELONY criminals, these laws DO NOT PERTAIN TO THEM!!! They ILLEGALLY ENJOY their UNLAWFUL 2nd Amendment Rights UNPUNISHED, buying and concealing firearms (NO PERMITS REQUIRED)!!!

The Democratic idea is to make it difficult and expensive to do any type of gun, or ammo, purchase. This is their solution to gun control. Problem is that the criminals don’t care. Heck, CA ended up with a background check just to buy ammo; glad it got shot down after a year+ litigation.

Tax relief on guns and ammo - great job DeSantis. CA, meanwhile, has that 11% additional tax on both.
