This is how the Police and DA's work against 2A Rights

Can’t find my OP on this one so I’ll post this follow up here:

The guy, Gamboa never pointed his rifle at or shot at anyone but he got arrested, the guy that DID point his gun at people and fired 3 shots, killing one man and injuring Gamboa walked away clean. But that’s not the end, the Police/DA decide they need to keep going, more investigation, more behind the scenes B.S. and I’ll bet you a buck they are trying to pin this on Gamboa.

The “PEACEKEEPER” who fired the fatal shot should be brought up on charges of murder.

As law abiding gunners, we are all responsible for every round we shoot. If I shoot and kill the bad guy with my first round and the second kills a bystander, I am responsible for that bystander’s life.

The guy with the AR should at least be charged with brandishing, disturbing the peace or something. His actions of charging someone while holding a weapon warrants response. If he had his weapon in his hand and charged me, it would be pewpewpewpewpew…until he stopped charging.

It doesn’t matter if he doesn’t fire a round. He has his weapon out, and he is charging. That constitutes a direct threat against my life, the lives of my loved ones and others around me.

Interesting. Taking the initial eye witnesses reports at face value, “[Gamboa] then lifted the rifle, and according to witnesses he began to run toward the large crowd gathered on State Street holding the rifle in a firing position”. That is assault with a deadly. No question. A felony. Someone died during the commission of that felony, that’s felony murder on Gamboa. Again, no question. It doesn’t matter if Gamboa killed the person or not or whether it was an accident or not. Now the shooter - The shooter was acting in self defense of himself and others if he saw the same thing the witnesses saw. No charges is correct.

However, it appears they don’t have enough evidence to prove assault with a deadly, so they can’t charge anyone. “As previously discussed, there is ample information already made public that did not show Mr. Gamboa pointing his rifle at anyone, but only showed other individuals firing guns at Mr. Gamboa”.

Yea, that was the initial report but later cell phone videos show him running with it at low (pointed at the ground) ready, which in Utah is perfectly legal, Stupid for sure but legal. I suspect that video was several seconds into the fight, maybe they have earlier video the shows/doesn’t show him raising the barrel. What I do know is DA Sim Gill would have this guy Locked Up if he had definitive evidence.

Off topic, but I came across this article and the embedded video recreating the breonna taylor shooting really shows how split second these things are and how even people trained can react solely on reflex. Expecting rational thought and decision making is not realistic. All split second reflex. The one cop has no recollection of emptying his 16 round mag. Total reflex. I don’t know enough about the shooting to judge anyone, but the middle portion of the video showing all of the shots fired is pretty stunning.

To your comment I quoted, note how some of the shots entered the adjoining apartments.
