The Constitution and the 2nd Amendment

THE CONSTITUTION AND FIREARMS

Amendment II:  A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

Pretty clear, but this is NOT the only place in the Constitution where this and other rights are covered.

I will go over these other areas, but keep in mind that these are my opinions, with explanations of why I feel this way.

ARTICLEIV, SECTION 2: The Citizens of each state shall be entitled to all Privileges and Immunities in Citizens of the several States.
In other words, your driver’s license, marriage license, and others are recognized in all states, then your firearms license should be also.

ARTICLE V1: This Constitution and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

This means that the Constitution and FEDERAL law shall be OVER any state law that constricts the rights of any citizen. So. If the Constitution guarantees a right, then NO STATE LAW can undermine it. So any state law restricting your right to firearms is null and void.

AMENDMENT V: No person….shall be deprived of life, liberty, or property, without due process of law; nor shall property be taken for public use, without just compensation.

This means that taking away your 2nd Amendment rights is taking away your right to life, (in many cases) and “red flag laws” that take away your firearms without due process of law are illegal.

AMENDMENT XIV: No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States: …

See all the above.

AMENDMENT XXVI: The right of citizens … who are eighteen years of age or older, to vote shall not be denied or abridged by the United States or any State on account of age.

So, if you are 18 and can vote, (then you are considered of majority as opposed to minority) then you are able to keep and bear arms.

The real reason the 2nd Amendment was included in the Constitution was found in the Declaration of Independence, in the second paragraph: “THAT WHENEVER ANY FORM OF GOVERNMENT BECOMES DESTRUCTIVE OF THESE ENDS, IT IS THE RIGHT OF THE PEOPLE TO ALTER OR ABOLISH ITAND TO INSTITUTE A NEW GOVERNMENT.”

These reasons are why people feel so strongly about our rights, not only the 2nd, but ALL rights given by God and guaranteed by our Constitution.

When someone tells me something mean something other than what it says a red flag goes up. So what you mean is this is one’s opinion. It means what it says. One cannot take that away from the framers or founding fathers.

nothing taken away. My opinions, but these are IN the constitution, and these are the way I read them. I am not going against it, but FOR it. No need for a red flag. I am 100% pro gun. Reread it with that in mind. Trying to show the antis why they are wrong.

All the antis get chased away. I know you have good intentions. I hate to say it, you are preaching to the choir. I wish we had antis here, I think they could appreciate your post.

Plus I don’t think antis care about the constitution, they care about their emotions. I use to be anti. My emotions told me less guns less murders. Then I realize it takes gun to stop murders. That is too emotional. They are scared of murders. Then there is the political side of it. I’ll save that for another day.
