New law in San Jose CA

They won’t need to tax free speech. Big tech is already doing that for free.

Thanks for the discussion, interesting comments. But, I am not hearing… “Sounds like taxation without representation” or simple “No this is not happening”; “Our forefathers wrote into our Constitution preventing such tyranny”! They very clearly drew a line and you are trying to cross it.

All the politicians swore an Oath to uphold the Constitution, for sure all the leftist Democratic’s Lied, they should all resign or be fired.

These types of laws in CA get passed in SJW cities and the CRPA, FPC, etc come in and file a lawsuit. Then the cities take a knee and bow out or get decimated in court.

Why do y’all keep electing and re-electing these MORONS??

The latest headlines are the Dems complaining about the SCOTUS rulings on voting. The lead MORON is repeating the call to pack the court. If they pack the court they can begin legislating from the bench and start gutting the Constitutional protections. This has been part of their strategy for quite awhile. That way they don’t have to worry about electing a majority of their MORONS, just let the court do their work for them.

I would say “burn it down” but it appears God is already doing that.

San Jose is not a small town. It is the third largest city in CA with a population of over a million. If they manage to levy this tax, it’s only a matter of time before the rest of CA follows. Every goofy idea starts somewhere and we will have to depend on SCOTUS to set them straight.

Just like a 35% increase in gasoline prices.

Those who work in more affluent areas than they can afford to live and so noisy commute every day to work are harmed significantly more than the financially better off libs who vote for politicians that impose higher taxes.

If I recall high school civics correctly, McCullough v. Maryland, “the power to tax is the power to destroy.” How does that not apply to constitutional rights?

I’ve actually done a bit of research on this and will continue to watch it. I live in California in Stanislaus County, which is one county east of Santa Clara County where San Jose is the county seat and largest city (over 1MM). This potentially affects me, especially on how they apply this (think about staying in a hotel for training, or someone visiting friends or relatives).

At this point, it was on the agenda this week. It is not yet an ordinance, but just a memorandum of what they want to do. It specifies: “require every gun owner residing in the City of San José…”

Here is a link to the full content: San Jose City Council agenda item - Reducing Gun Harm, and the Public Burdens of Gun Violence.

But also they are researching to see what they can do legally: “The City Attorney shall evaluate the legal feasibility of applying these requirements upon all persons possessing a firearm in the City of San Jose, whether they reside here or not.”

They are looking to see if they can force this on CCW holders or if state preemption restricts: “An exemption from these requirements will exist for holders of a concealed carry weapon (CCW) permits, if the City Attorney deems it necessary to do so to avoid conflicts with state preemption over CCW regulation.” Note that it is impossible to get a CCW permit in Santa Clara County, and San Jose defers all CCW applicants to the County.* However, there are people who reside elsewhere in the state and may own property in San Jose.**

If you look at the full agenda item, you’ll see this is but a over a half-dozen different “gun control” items they are pushing - basically everything you’ve heard California or anyone else propose to hamper legal gun owners, they’ve got it on their agenda and are trying to pass local ordinances and use existing state laws (like California’s GVRO) to go after gun owners, and to “enhance communication between the San José Police Department and other local law enforcement with key Federal agencies.”

I see this sort of thing as where high concentrations of people with a mindset of liberal anti-gun ideologies with a ton of money (this is Silicon Valley, median home cost is $1.2MM) are trying to push every single anti-gun lever that they can find. Additionally, after testing out local ordinances, if they stand and aren’t defeated in the courts, they will spread to the state level of California, and then be pushed at a Federal level. This is basically a cancer that we need to fight so it cannot spread.

*The existing Santa Clara County CCWs are almost all certainly issued based on corrupt bribery “Pay to Play”.

who’s “y’all” ? It’s not the folks on this forum guaranteed. Unfortunately in some areas of the country, we are simply outnumbered by brain sharing idiots.
Case in point, my small town here in CT goes 2:1 red to blue. We had Trump with 67% to bidens 33%, our town hall is 100% GOP, from the mayor through the clerk, any position requiring a vote…but, my state reps are blumenthal and murphy, and the state capitol is a huge blue majority…and no, my neighbors and I didn’t vote for them…except for one guy, and he’s an idiot.

Well there is Hope here in California! Larry Elder is running for Governor, if we can get Newsome voted out on the recall. We need Truth back in our Society. Enough with all the propaganda and political agendas! USCCA members; especially from California Vote to Recall Newsome and let’s put Larry Elder in!

If I were in Cali, I would support Elder…but even if he wins he’ll be handcuffed by an overwhelming majority democratic State legislature.

I remember getting stationed in Lemoore Cali in 1973 for about 18 months. I was in the Navy. Even as a young 18yo, I could see Cali was heading the wrong way politically.

When I went back for training at NAS North Island, that was confirmed.

I went back last in 2005 and I couldn’t believe Downtown LA!!! As beautiful as Cali is…I just won’t go there now.
