New Background Check Procedure

About a month ago I bought a new gun from Academy Sports here in Florida. I went thru the usual routine of filling out the computer tablet and awaiting the results. I have a Florida CCW permit so the process is usually speedier and there is no waiting period. It took about an hour and a half, and I was ecstatic for the short wait.

Fast forward to last week. I ordered a new gun from Kentucky Gun and had it shipped to a pawn shop near me to receive and run my background check. After I filled out the pen and ink paperwork the counter guy called a phone number, talked to the other person for about a minute, and told me to hang out for about 15 minutes. Sure enough, 15 minutes later he got a call back and I was cleared to go.

Has something changed with ATF that now FFLs can call in background checks and get results in 15 minutes? He had a confirmation code and all he wrote on my paperwork. This is not the first time I have used him but this is the first time he has gotten approval over the phone, and fast!

Clueless Assemblymember Celeste Rodriguez from Los Angeles County introduced AB 1187 that requires every person who buys a gun to complete an 8-hour class that includes live-fire shooting exercises at a range.

Here in Kentucky I have never waited more than 15 minutes to get a response on a background check, usually less. That applies for both digital and paper forms at chain stores, gun stores and pawn shops.

Don’t know what’s up with Florida.

Around here, if you have a CCW card it’s automatic, walk in buy it walk out.

Wow… it actually took 10 minutes longer than Internet background check in IL :wink:
I’m guessing the time varies, depending on location and how common your name is.
Every time I bought a firearm and FFL run my background it took no more than 4 -5 minutes.

With Mike164. Here, if you have a CCW, fill out form, pay, and walk out with your gun. The CCW is your background check. The way it should be. If you don’t have a CCW, fill out form, they will make the call, if they get the OK, pay and walk out with your new firearm. Again, the way it should be. Damn glad I moved out of the People’s Republic of CA.

If only life was that simple. Here in MD you still have to wait 7 days even with the CCW.

In MA, 15 minutes is a long wait before walking out with it… (and paper is better because ur info and purchase isnt stored online)

Here in Wisconsin I have never waited very long and well under 15 minutes. I have a CCP but it is not used for purchase.

In Indiana it takes ten to fifteen minutes. It’s faster if you are a frequent flyer.

So…even though this is a Federal background check, the States get to dictate and control? I learn something every day, and at 80 that says a lot…lol.

In PA it usually takes 15-30 mins for the background check to come back- longer if a gun show is in town :slight_smile:

Not exactly. In states that use a full FBI background check when issuing the CCW/CCL, ATF has made a formal deal that FFLs can complete the sale without waiting for the NICS check report. We have this in Arkansas, too. However, the buyer still has to complete the 4473, just as everyone else. For the big box stores with electronic forms, I am sure that the NICS check proceeds, and I assume that the paper-based FFLs still have to call in the NICS check but not wait for the call back approval.

Thanks for the update. Makes a little more sense now. I just can’t wrap my ahead around how one FFL in Florida works different from another FFL in the same area. I’ll have to ask the pawn shop next time I go in to ‘browse’. Gotta save up my ‘browsing’ money first.
