So, why do you believe this was NOT a trial in violation of the 6th Amendment? I know that Trump and his supporters want to claim that he was not found guilty of engaging in an insurrection, but the facts of the Colorado case seem otherwise. He had a 5 day proceeding before a judge (he did not choose a trial before a jury – his choice) where evidence was presented (Trump’s lawyers would have participated in that calling their own witnesses and submitting documentary evidence) and the trial judge made a finding.

I’m no legal expert but it seems to me he is not actually being directly tried for his crime and is not being tried in the jurisdiction the crime was alleged to have been committed in. If he was convicted of this crime by this court why is he just being held from the ballot and not being sentenced for his crime?
Seems like a total mess if every state can independently try political candidates and declare they are guilty or innocent of crimes that occurred outside their jurisdictions when those crimes have not yet been prosecuted where they took place.
I don’t like Trump but it seems like a dangerous precedent to leave it up to each individual State to independently decide guilt and innocence. What happens when the Republican States start doing the same for all of Biden’s alleged crimes? This looks like politicians and judges taking the decision away from the people. If Democrats are so intent on keeping Trump out of office then they need to find a candidate that deserves to be in the White House instead of one that should be in rest home or jail. Though I would say the same to Republicans who don’t want 4 more years of Biden as well.
The trial court made a finding that Trump had engaged in an insurrection after a 5 day “trial” in which evidence was submitted. The 14th Amendment does not require a criminal conviction for insurrection merely that the individual “engaged in insurrection or rebellion … or given aid or comfort to the enemies thereof.” I suspect that Trump’s directive that the attendees go over to the Capitol and “fight like hell” and “you’ll never take back the country with weakness” and his subsequent hours long delay in calling in law enforcement to quell the matter figured into the finding that he engaged in insurrection.
No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

This reminds me of the shortsightedness of the Republicans with Citizens United. That got passed because Bush the Younger had the Koch Brothers and their Billions, so they wanted unlimited dark money and now Democrats are raw dogging the Republicans with their own Billionaires and their own dark money. Would not surprise me for all of the Republican states to boot Biden off the ticket for his crimes. Then what. No one can win the election.

Our politi-critters on both sides are setting up this country for a possible disaster post-election. With the DNC tying to take Trump off the ticket and with questions about election integrity already being an issue, many Republicans will never accept the results. Likewise, threatening to drop Biden from the ballots in Red states along with previous claims of election interference will cause even more Democrats to deny the election results if Trump wins. We know for sure that the Libs in Antifa and BLM will riot, that’s a given. What will happen if Trump loses this one? I hope everybody enjoyed this last Thanksgiving and Christmas.
