thanks for the correction
I am not splitting hairs here, this is how it works;
The threat was not eliminated. However, the threat was significantly reduced thereby making the rest of your comments to be accurate.
I bring this up because if anyone chooses to take this kind of action they must be vigilant to second guns, edged weapons and so on. They have bought a ticket to ride the event out to a safe conclusion where the suspect is no longer their responsibility.
Furthermore, such a choice will tax the person beyond the responsibility of maintaining vigilance over the bad guy, but invariably the police will come in hot and start shouting commands. This is big time multi-tasking now.
CCW can carry some heavy weight.
Please explain what you mean here, thanks in advance.
I believe that what brother @Steven288 is trying to say is that carrying a firearm comes with a great responsibility.

This is what I have to say.
He did everything 100%. I wouldnāt convict him if I was in a jury.
- He stopped the threat.
- He made sure he stopped the threat.
- He made sure the threat wasnāt coming back up.
- The robber is clearly a deadly threat to everyone around him.
- He could have had a 2nd real gun.
- The first thing heād be doing when he gets a hold of a real gun is shoot the self defender.
- Once the self defender is shot or dead, everyone once again is now in danger to our robber.
That is why I believe he is justified.
As for dumping the drinks on the guy, and throwing the fake gun out of anger, Iām not going to really care about that, he had to take care of his emotions.
Morally: Justified
Tactically: 100%
Legally: in my opinion NOT GUILTY AND IS A HERO!
Somebody give this man a trophy.

I remember that.
Many fake guns look like the real thing. I have heard of people even painting the orange barrel tips black. I have seen a few airsoft. at distance and sometimes close up tough to tell. ![]()
Have a great day David
As a small point, I would note that ācouldā is generally not what you want to determine the use of lethal force on. As in āhe could have a second real gunā may not be the best case for killing someone. A lot of things ācouldā be. But, did you have a reasonable belief of that thing?
My personal standard here is, the person behind you in line at the grocery store could pull out a knife and stab you in the kidney, but you probably wonāt shoot them because that is something they could do.
This is where, in my totally non lawyer non legal just a guy opinion, the argument of āhe was shot in the back of the head because he ācouldā have had a second gun and woken up to use itā reasoning falls short.
He might get a pass on that given the totality of the circumstances but since we arenāt on the jury and we are using this as a teaching point and lessons learned, IMO, one of the biggest takeaways should unequivocally be ādonāt do thatā. Even if he isnāt charged or isnāt found guiltyā¦this is still IMO an exampleā¦in partā¦the last shot at the very leastā¦of what not to do.

This will be presented to the grand jury in due course. The miscreant was a convicted felon. Initially charged with capital murder, reduced to aggravated robbery, sentenced to 15 years in 2015 and released from prison in 2021. Depending on whether the DA wants to nail the shooter, I suspect this will come out. Prior criminal history didnāt help the fellows in the Floyd case, but wait and watch. The shooter contacted the DA and HPD Homicide through an attorney and is cooperating.
