Has anybody out there been denied the purchase of a firearm even though I’ve had a concealed carry license for years?
I am a Vietnam veteran, never had a felony conviction, own my own home, and I’m almost debt free. I
I don’t drink, I don’t do drugs, yet the FBI shot down my background check.
I have never been denied a gun purchase.
Has this ever happened to anyone else out there, is there any recourse?
Who denied you the sale of a firearm and what was the excuse given?
The FFl dealer I used said the FBI flagged me with a big red NO!
Gave no reason.
That’s the frustrating part of this game they play. Around here if you get denied they give you a web address to ask why. And, as usual you may never get an answer.
Welcome aboard.
I have not, but grandson had a situation, even after grandpa urged him to check his 4473 for ANY discrepancies. Long story short, grandson moved and the addresses on 4473 and drivers license did not match. Big red flag.
Me I would double, triple and quadruple check my 4473, one wrong letter and it’s a red flag. So if they don’t like the abbreviation “Blnd” or “Bld” both of which have always been acceptable for blonde could be mistaken for BALD, it’s flagged.
If you realize that Supreme Court justices can’t define woman, that one wrong letter makes a big difference. Did you use you “optional” SSN? That can help clear the way, try again different dealer!
Hope someone can help up you better than I , and please keep us informed. It could be a back door operation to squash the 2A!
Any time a government bureaucrat is delegated the authority to deny or approve a fundamental right, it’s a recipe for abuse.
My state, Colorado, is theoretically a shall issue state meaning anyone with a clear background check, payment of the requisite fee and successful completion of the qualification course shall be issued a CCW. However, in the real world, local sheriffs have the discretion to deny a permit, so that reality makes Colorado a “may issue” state. I learned this when clients came to me who had been denied a permit, even though they held top secret clearances. Seems the local sheriff denied political opponents and took the position that they could sue him if they did not like it. After all, the sheriff’s actions are defended by the county attorney with a virtually unlimited legal warchest of taxpayer money.
I guess you could sue the FBI, but its legal warchest is even bigger than my little county’s sheriff who was punishing political rivals (all the while claiming to be pro 2A and touting endorsements from the worthless NRA).
Thank you for the response
Could you tell me what a 4473 is?
Thank you for the response
Could you yell me what a 4473 is?
Of course, ATF form 4473, required when purchasing a firearm.
Firearms transaction record!
PDF and printable
thanks, makes sense now
See above sir. This is the ATF form in question. I wish you luck resolving this issue. Almost all denials are a mistake and often a data-entry mismatch or error.
thank you for the positive thoughts
Welcome @Gary474!
Yes, definitely check that 4473 info is accurate and matched your ID. Also, not sure if you provided your SSN, but that helps in case there is someone out there with a similar name who has a questionable history.
There is an appeal process. Check online for info, or talk to your local FFL. It is very possible you have the same name as someone else, and that person is blacklisted. If this is the case, you should apply for a UPIN (Unique Personal Identification Number).
XX vs XY?
If it turns out to be more than a mistake on the 4473, contact an attorney. There’s a local attorney where I live who specializes in 2A and self-defense cases, and he told me that restoring people’s access to firearms are some of his more common cases.
All the info on your 4473 has to match your dl exactly, aside from height and weight. If it doesn’t, you’ll be rejected or have a delay. If the answer for 21.n is no, 21n1 you select the “x” now…not “no”. Make sure you read all the questions slowly and answer correctly. There are a few that give you an automatic rejection if you answer yes instead of no, or vice versa. Id redo the 4473, double check the answers, and see how it goes.
Please keep in mind that there is no power in the word “yes.”
On the other hand, the power gluttons in guvment absolutely love the word “NO!”
That should answer a lot of questions.
The new paperwork is posted above to buy purchase firearms as been worded in such a way that if you’re not sure it will mess you up. Luckily I was out at my local firearms store. They know me and they were able to point it out but on the military base they told me we cannot.
