bank covered by a federal property umbrella, gun free zone

i was carrying in my bank when one of the people came and said that under federal law banks are gun free zones. When I challenged her saying they are not a federal property, she made the claim that they are by an umbrella clause. I was going to challenge that as I had no idea or not.
(I carry concealed, evidently not that good on this day.)

I am curious to know if that is true and if not what would be the best way to advise her she is miss informed. I will honor the request and keep it in the car, just hard to do when one is depositing large amounts of cash. I run a Gold and Silver bullion store, hence the large amounts of cash.

I do not believer her, I also think that would be something that would have been something covered in the CCP/CCW class, or any of the legal seminars on gun laws.

Appreciate the help in advance.
side note, thought this might make a nice video in the ask an attorney series … how best handle miss informed people.

She was throwing BS at you, but she may have actually believed what she said; if so, she was not lying.
What really matters is a combination of state law, bank policy, and signage at the bank’s door. In some states, a no guns sign means you are only breaking a bank’s policy; the most they can do is trespass you if they know you are carrying. In some other states,
signage carries the weight of law, and you could be breaking a law by carrying past the sign. And in a third situation, some states make violating the sign a crime IF the signage meets specific criteria for wording, language, size, etc. Texas is in that third category with their famous 30.06 sign law.
You can check the details on every state a handgunlaw.us and on the USCCA Reciprocity map page.
Best advice: as you noted, carry concealed, and remember concealed means concealed. And don’t get into arguments with the hired help. If their sign does not meet the state law requirements, DO NOT point that out. They will just fix the darn thing.

The statute covering carrying in a “Federal Facility” is here:

18 U.S. Code § 930(a), specifically:

Except as provided in subsection (d), whoever knowingly possesses or causes to be present a firearm or other dangerous weapon Federal facility other than a Federal court facility or attempts to do so, shall be fined under this title or imprisoned not more than 1 year, or both.

The term “Federal Facility” is defined as under statute as: “The term “Federal facility means a building or part thereof owned or leased by the Federal Government, where Federal employees are regularly present for the purpose of performing their official duties.

A bank is often a federally chartered entity, but a bank building is not typically a “Federal facility” unless there are federal employees regularly present for the purpose of performing their official duties.

BTW, USCCA covers this topic here:

Federally Banned Locations for Carrying Firearms | USCCA (usconcealedcarry.com)

That said, it’s not worth getting into a pushing match with anyone who tells you to leave because they saw your concealed carry firearm and believe you are forbidden from carry there. Doing so will just invite the cops to the building to sort things out, and there’s nothing good that will come of that. Leave the building. They don’t want your business. Take it elsewhere to another bank that does want your business.

…and then there were none! We’re coming close to this type of situation. Soon there will be no where to eat, sleep, shop or bank! I gather we’ll just meme about it instead of fixing the communist party in power!

I admire your honesty.

I don’t recall ever hearing about banks as no-go zones. But, hoplophobia makes people imagine things.

Since most banks are federally insured, many people assume they’re federal property like courthouses, where guns aren’t allowed. However, the reality is that there’s no federal law against carrying a gun in a bank. As long as you are legally allowed to open or conceal carry a weapon in your state, you can bring it with you into a bank.
The lack of federal laws on carrying guns in banks doesn’t mean you automatically have the legal right to take a gun wherever you want. Banks are private property, so they have the right to determine who does or doesn’t bring guns into their buildings.
Before visiting a bank, it’s a good idea to learn about their gun rules so you can behave appropriately. If you’re allowed to take your gun in the bank, a few simple steps can help you avoid awkward misunderstandings. First of all, you should keep your gun holstered. Avoid tucking the gun haphazardly in your clothing, under a folder, or in anything else that makes you look like you’re trying to hide an unholstered weapon.
No matter where you’re choosing to carry a firearm, it’s essential to make sure you learn how to do it safely and follow the laws in your jurisdiction.

The majority of the electorate no longer votes at all and decent people are too lazy or disillusioned to step out of their private lives to run for public office, so we get a choice of elderly charlatans seeking to hold office 'til they die.

The Dems are socialist, but Rs, who are obsessed with social and sexual issues, are the “morality police” version of socialists. Both endorse printing money for social programs, military adventurism and growing the administrative state. There’s not a dime’s difference between the two – we live with a Uniparty, just like in a Communist county.

The best individuals can do is to take actions to protect themselves from the 3 Chinese curses:

  1. May you live in interesting times
  2. May you come to the attention of higher power
  3. May ALL of your dreams come true.
