ATF nfa question

I am searching for anyone that can help with an issue I have encountered when trying to purchase a suppressor.

The atf is denying me because of a disorderly conduct violation 40 plus years ago at the age of 17.

After trying to locate the said charge here in my state and county no one in the courts have any information on this said issue? In fact my record shows the only misdemeanor I have on record is vehicle tickets, ie speeding , stop sign???

Yet the atf and fbi are trying to correlate this issue with domestic violence it seems??? What’s alarming is they do not even have any evidence or information other than a card with my fingerprints saying misdemeanor disorderly conduct back in 1978

I have appealed, I have sent paper work and yet no one with the administration wants to listen? I have never been before a judge or court etc
. With a single case???

Anyone that can help or have information to support would be greatly appreciated!

I had the same thing happen to me when I went for my CCW Permit. The letter I got said I was denied and if I wanted to appeal, I would have to make an appointment with the sheriff and that’s what I did. When I talked to the sheriff, he looked at me and said how long ago was this? I told him that he looked back at my record and said this was 50 years ago so I got my CCW permit.

Funny thing with my situation is I have been purchasing guns since I was 18, and have my cdl , but what’s most interesting is I had my firearms license to sell years back that was approved by these same people?

I spoke with the people at the atf and all they can say is I need to locate the case and send in a letter of the case and what the outcome was??? How can I do that when there are no records of this incident???

Call an attorney, because there IS record of the case apparently
..

Someone here may know the proper legalese route to finding that information, but directly speaking to an attorney will likely resolve it faster.

I think you need to go higher up the totem pole. In my state it is the county sheriff.

Everyone, thanks for info, I have reached out to an attorney, however the costs have placed reservations on my budget
. I say this because I have been to the court house, spoken the legislation in our capital and the outcome has been there is no record of the event! I guess my fear is the lawyer will come to the same conclusion and money spent on something I already learned!

Now if a lawyer can help in speaking to the fbi atf etc to learn more about their reasoning and change the process, I would be happy to hire!

How can they deny you your stamp if the record doesn’t exist. I would ask who found it to show it to you. Maybe write your congressman.

Exactly , all they’re telling me is they need a resolution to the so called case? And that’s where I have been stopped by all my states legal system, no case , no history of a case no resolution???

So that’s my problem, and I asked the fbi and atf for more information and all they gave me was a picture of a card saying disorderly conduct misdemeanor in 1978!

So they have nothing either ???

Frustration is only part of what I have gone through!

Did you get arrested and fingerprinted in 1978 for disorderly conduct?

If yes: there is more than just that card on record.

If no:
A) It could be a case of misidentification, maybe your name or SSN was typoed on the form 4?

B) Possibly a case of identity theft or fraud.

Triple check that all your information is correct down to punctuation.

Did the court house provide you with documentation that there is no record on file that can be sent to the ATF?

Hello, yes I have the documents from then until now, and there are no records or any offenses. I have a clean record , I was never arrested, we meaning myself and a few others were riding dirt bikes and probably made to much noise and got out of hand, so this little police force took all of us in and I guess trying to scare us took fingerprints and had a long talking too. I don’t believe the fingerprint card was even supposed to have been filed, however somehow it made its way to the fbi??? I was also told that the fbi will not except certified letters of a persons record when they are saying an offense was committed, they want a resolution of the case??? This is where I am at my wits end, how can I produce a resolution to anything when there is no actual case in the first place !

Whatever this issue is about, regardless of what’s on record, you were a minor(17), and shouldn’t that record be sealed and have nothing to do with you as an adult? I would ask a lawyer about this, look into it and have it expunged. USCCA insurance can help you with expungement cases if you’re a member. Whatever this record is its way past its statutes of limitations.

Check atf record of fingerprints versus/with your own.

FBI ‘s response to that was “my fingerprints are on the card”

I spoke to someone in the department and she informed me I was charged with domestic violence “””” she had me second guessing myself to the point where I was racking my brain thinking back 40 plus years if I had been in a fight ? And just totally forgot I was arrested??? The fbi played mind games and still are, and this is all over the purchase of a suppressor?

My last resort is to hire an attorney and let them make an investigation with the hope they can get this resolved?

Also, the response that at 17 you are considered a minor, I thought that as well , however in our state 17 is considered an adult??? I did acquire my records as a minor and they too show no sign of any criminal history
.. it’s a real shame the fbi won’t give this a look so they can see for themselves I have no criminal record and nothing that should keep me from obtaining a suppressor

. I feel my civil rights are being abused!
