Cruz, who was 18, was told by his district that he no longer qualified for special services (a lie). That same law I cited, PL94-142 requires districts to provide complete services until the individual reaches the age of 21. They screwed up in this particular case. I’ve fought, and won, numerous times against districts who tried this very trick.
For Cruz it was the straw that broke the camel’s back. Had he continued to receive support and adequate MH services I believe no shooting would have occurred. So the question is who’s to blame? IMO the district is. They just wanted to move him on out. We know how that worked out for them.
