If someone threatened me with a syringe, would that constitute a deadly threat? I’ve seen multiple reports of people threatening others with syringes infected with AIDS or full of air and is that a valid situation to use lethal force?
I’m just concerned that someone could think they could stab me with anything and I not have the ability to use up to lethal force to stop the threat…
BTW: I read some time back that it would take a lot more than one syringe of air to kill a person. Google it. It makes a great movie plot but it’s not real.
As a nurse @KillJoy is correct…it would take a pretty big syringe (15cc or bigger) and the air would have to go directly into a vein…very unlikely to happen. But a dirty (bloody) needle/syringe is every bit as deadly as a knife. But as always you have to show threat of death or serious bodily harm. A dirty needle is capable of both.
With no way of knowing what’s IN the syringe, I would treat it as a deadly threat. Is there air in it, or is it filled with Drano? Is it infected with AIDS or COVID? Impossible to tell by looking at it. If they’re threatening you with it, the implication is that it will do bodily harm, so you’re supposed to comply with their demands. Not much different than a perp threatening people with a BB Gun or Pellet Gun as if it’s a real firearm.
As for whether you can, or should use deadly force against the person, I would think to treat it as if it were a knife, rather than a firearm. If they can get close enough to you, they can stab you with it. If they’re 15 feet away, that’s one thing. But if they charge you with it, then all bets are off.
There’s an old saying - “Your rights end at the end of your fist -my rights begin at the end of my nose.” - I read an account of an old woman who killed a purse-snatcher after stabbing him with a 9" hatpin in the heart - his death was a delayed-action, and the cause was only apparent at the autopsy. Bad behavior should always have consequences - PERIOD!
