Yes, it’s part of the “Plain View” doctrine formed in 4th Amendment cases. It basically says that probably-cause contraband can be seized if it’s in plain view.
How this plays out is that an officer asks to come inside and you consent. While standing in your entry way, the officer notices your unregistered M2 .50 cal hanging on your mantle, and you get into “hot doo-doo” (legal term).
Another example, you’re pulled over in Massachusetts for a broken tail light and the LE officer notices your illegal 50-round ‘clip’ for your full-semi-automatic war machine laying in the back seat. You’re in hot doo-doo.
What law enforcement cannot do is conduct a full search of your home / vehicle without your consent, nor move items around to search for contraband without a warrant or probable cause. But if LE is in a place they’re permitted to be and can see an illegal item in plain view, they can seize it.
As with most current “gun control”, they will be exempt. Nothing like creating special classes of citizens in an egalitarian society… feels like… Socialism at its finest.
This reminds me of people that claim we live in a Democracy and believe in equality. The first thing they want is to pay fewer/no taxes, but want the “rich” to pay more - their “fair share”. If one believes in equality, shouldn’t we all being paying the same amount to support the government programs they want provided to them for “free”?
You don’t need a safe to prevent accidents. Follow colonel Jeff Cooper’s rules and make sure that everyone who has access firearms knows the rules. If they are not capable of following the rules then you have to prevent access.
Exactly, much like you’d take a firearms class. Optional, catered to what the individual is looking for.
That could actually get interesting and turn into a home defense assessment, which might include things like appropriate weapons, an emergency safety plan (getting to family members during a home invasion and getting them to safety).
But not something I would want (or trust) a Government agency to do.
I wasn’t aware his case got overturned or that he was found dead. That guy had his world turned upside down all because he tried to follow the stupid laws and legally register his firearms.
I tend to believe he’s trolling all of us because I find it hard to believe he IS a gun owner and is that ignorant or would have the audacity to suggest such a ridiculous idea. Though, when it comes to dem ideas…it wouldn’t surprise me to find out he was sincere and really is that naive.
The truth is ideas are like butt holes…everyone has them and some stink more than others.
I notified the admins here a few days ago, and it seems that screen name on the other forum has been removed. Not sure if it would be right to post the forum or not.
It is called the plain sight rule. They see a Marijuana plant growing on the service porch in a state with laws against such and you are busted. Your brother walks in to the room and he looks like the picture in the morning briefing, once again busted.
But none of this is the point. We have constitutional rights that most countries don’t have. We do not have a true national registry and long guns are almost invisible record wise. The 4th amendment protects us from unreasonable searches and the fifth helps to make sure we don’t incriminate ourselves. Having the police come in and inspect our weapons would in fact create a registry that could go national with the hitting of the enter key on a police computer. Laws will not make the majority of gun shooting go down. if they could you could decrease gun deaths by more than 60 percent by making in a crime to commit suicide! yes I know that is silly but think about it. Criminals aren’t likely to ask for an inspection I don’t believe. And while they inspect registered guns hasn’t Knife crime skyrocketed?
“Knife crime in London has risen to a new high amid a nationwide surge in blade-offending, official figures revealed today. The Office for National Statistics said that 15,080 knife offences were recorded in the capital during the 12 months to the end of last September.” That is getting into the suicide range in the US.
" There were 19,392 firearm -related suicides in the U.S. in 2010. In 2017, over half of the nation’s 47,173 suicides involved a firearm. The U.S. Department of Justice reports that about 60% of all adult firearm deaths are by suicide, 61% more than deaths by homicide."
So in short no I am not the least bit interested in have the Police inspect my firearm storage. Just like my founding fathers weren’t interested in the British inspecting how they stored firearms. The Spartans said it best when the Persians wanted to inspect their weapons, " Molon Labe ".
No way that is a major infringement on our privacy and 2A makes no such requirement. Not to mention it opens the door for corruption. Think it would be uncommon for a cop to request a bribe or he’ll report you as negligent? We don’t need more oversight in this country for the people. Our elected officials need more oversight.
With a little research and training you should be able to do your own inspection (without additional drain of LEO resources). The police are only given the task of solving crime. You are the one responsible for your safety.
What government program has ever met the needs of everyone? One size-fits -all cannot be a benefit to every different situation, such as taking into account the needs of a person with disabilities and their different abilities to access safe storage systems.
Recording serial numbers and other firearm information will not enhance safety, or cure ignorance. This information has been used by many governments to be followed by confiscation “for the safety of citizens”. The next step is the police state or what ever name is given to power hungry rulers.
Refer to the Jews for Preservation of Firearms Ownership ([email protected]) for a list of countries that have followed this logic and murdered millions of their citizens that did not meet the approval of the rulers.
