Out of state gun purchases

I live in Arkansas and went to Dallas to visit for a few days.

I went to a local gun shop and looking for a revolver as a backup conceal carry.

We talked and I saw one I liked, he said do I have a FFL to send it to when I purchased the new gun.

I get upset about this cause, I can bring my EDC into Texas and I have an enhanced concealed carry permit. But not but one and carry it back to Arkansas.

BUT!! I can buy a long rifle or shotgun and take to with me, (as many as I want) but not a revolver.

You let me carry my EDC all over the state of Texas, but not trust me to buy it and carry it back with me.

Of all the gun laws that are changing can at least they fix this, even if the chain store is in my state.

Is this like this in all the states or what.

It didn’t use to be like that. I think it is like that all over now. I don’t know what the purpose is.

It has been like that for over 20 years. It is all about Federal law, not Texas law. Yes, long guns are ok to buy outside your home state, but handguns have to be transferred across state lines by FFL to FFL transfer.

The gripe comes from the fact that you can carry across state lines legally. You don’t have to ship your EDC to the FFL to get it into or out of the state,….

So why can’t you buy a new handgun and just carry it home same as the one you’re already carrying on your hip?

Because you bought it out of state. You can carry it across state lines but you can’t buy it and carry it across states lines.

Yeah,… okay,…. I bought my pistol in Colorado,… I can carry it into any of our bordering states; Arizona, New Mexico, Oklahoma, Kansas, Nebraska, Wyoming or Utah without having to transfer it through a FFL to cross those state lines.

So why does it matter if I purchase a pistol in any of those states and return to Colorado?

Why does THAT “new” pistol have to go through a FFL where the one I have on my hip the entire time I circled Colorado doesn’t?

So at a gun show: if someone is selling their gun and they are out of another state, then can they legally sell it to me in my own state.

From their personal inventory or their company??

If so then what is the difference??

Can I buy a gun from someones personal inventory that is out of my state??

An FFL could only sell guns in the state he is from.

States are whacked when it comes to laws. I can carry my EDC with my permit ( hate asking permission for a right) but legally cannot carry my EDC knife that has a 3.5" blade. Law says 3 inch max

So i cant carry a larger knife but my 9mm is fine???

Dont buy it. I still carry the 3.5". Been carrying it for about 20years.

A smaller blade will make someone just as dead.

Okay so my question is can I buy a gun from their personal inventory if I am out of state??

Can I sell my gun to a person when I am out of state from my own inventory??

A rifle you can but not a pistol.

If they are an FFL, you can as long as you have the gun legally.

IIRC you have to go through and FFL to sell any gun to anyone???

for your own well being that is probably best…

if a crime gets committed by someone using the gun you sell without going through an FFL

you could be held responsible…

Not unless your state has a law require background checks on all sales, usually called Universal Background Check (UBC). Most states do not have a UBC, so in those location s you can sell any of your guns, long or handgun, to another legal resident of your state while in your state as a face-to-face (FTF) sale.
The FTF sale is how owners, not FFLs, sell their guns at gun shows, swap meets, and other local contact situations. It is up to the seller to decide whether or how to confirm the legal residency and leglaity of ownership of the buyer.

I think that’s a ridiculous law as well. But for as much cheaper as I can usually get handguns right across the river,it’s still cheaper to have them transferred here. Still amazed I can buy any long gun I want on the spot. I’m getting a FFL in July if the stars align…then that craps over for me.
