New Mexico governor suspends right to carry ("emergency" order)

“The firearms suspension, classified as an emergency public health order, applies to open and concealed carry in most public places, from city sidewalks to urban recreational parks.”

Albuquerque area criminals and felons replied, “So it’s an emergency?? Oh. OK, I’ll turn in my guns immediately.”

For me, the interesting legal aspect of this is that the order banning firearms is cast as a public health order, akin to government pandemic orders that closed businesses and mandated masks in public spaces. New Mexico was one of the more stringent states with respect to government COVID pandemic-related orders. It looks like New Mexico assumes that if it can mandate masks and close businesses as a matter of public health, it can apply that same legal “emergency” rationale to carrying firearms.

NO IT CANNOT! And if we continue down this road, we’re going to find ourselves dead and buried! We don’t need lawyers and courts on this matter it was decided long ago, this is bullsh#t and we know it!
Where are all the “will not comply” people!

This on another thread, too. Worst was her stating that she knows it does nothing about criminals carrying, but states that this sends a message. Yes, it certainly does - not a good one.

So I know I am going to say the most obvious statement. This order, even if it was in place for a year already, would have done 0. ZERO stop these shootings. It is not law-abiding citizens who get their CCW, pay for the gun safety course, and can buy a gun legally who were the cause of this issue.

I will commend statements from some LEO in the state

In addition to my other question as to what kind of help or support NM gun owners are getting from the mighty NRA, etc., I wonder what a USCCA member from NM would get in the event of a self-defense case during the suspension of rights.

I believe that as long as the member was following applicable federal laws they would still be covered. But that would be worth confirming with a call or email to USCCA for those living in the area covered by this directive.

The “do not comply” people are the criminals who are doing the shootings that motivated the order. Unfortunately, the order makes otherwise law-abiding people into criminals, doesn’t it. That’s how government works in the world in which we live. And, to add insult to injury, no one seems to have a solution that does not involve magical thinking.

The governor in New Mexico said that she do not believe in the Constitutional oath she took when she was sworn into office, she also stated that her emergency orders override the Constitution.
