Perhaps so, but the post says he “can’t” and that the “laws need changing”, concern over how a DA might paint it is a very different thing from that.
Yeah, which is why I’m just going out on limbs here trying to figure out the post . Good hike today, legs up, thumbs needed a workout
. That’s what phones are for!!
Id still carry it, unless an actual law on paper somewhere that says a certain mod is illegal.
Ill take the chance in court.
Now if it has a glock switch or even a binary trigger, that could cross the lines in some states…but with the Apex, hes fine
To clarify. It’s not that I “can’t” it’s that I won’t. In my state there is no law against what you can carry - handgun wise - but my concern is with the courts and specifically the DA. If I tragically kill a POC, I think I would need all the help I could get on my side. Even if I was in the “right”. Anyways, I carry a bone stock Sig P938 with Tru-glo fiber optic. I like it a lot but I’m not in love with it.
I find it very difficult to be concerned about hypotheticals based on no real facts. I modify my guns to be the best they can be and perform at peak for ME! If I ever have to use it for a SD event I’ll make sure it’s a good shoot by knowing the laws cold and then I WILL get a good enough lawyer to eat up a silly investigator and prosecutor trying to hang his case on emotional BS.
My take is that if I actually end up in court my lawyer is an idiot and I need a better one.
These arguments are like having an old car or truck with its original equipment and being afraid of updating it for the better. I’ve seen some really great vehicles that the owners replaced the drum brakes for power disk, went to power steering and upgraded the rims, tires and suspension. God forbid you put in power windows and A/C. Then the modifications to the engine! No different with your EDC? If your car is street legal afterwards, no problem. If your gun is still legal after the mods then I totally agree with Enzo, if your attorney can’t keep you out of court, then you need new representation. We’re members of USCCA, I’d like to see them weigh in on this and put an end to the speculation. My EDC is a G43. Carried now for 8 yrs., made legal modifications and put several thousand rounds down range. After all this time, we understand each other. In answer to the topic, my favorite and the one I won’t ever not carry.
Bingo!
In CA, one’s required to list their pistols.
If it’s not listed, it’s illegal to carry.
I recall during CCW initial course, we were discouraged from making upgrades due to hypotheticals as @Enzo_T noted
There were other discouraging comments that I second- and triple-guessed myself: do I really want to apply for a CCW permit?
Sorry but If I had a dollar for every time I’ve heard silly stuff in a CC course I’d be a billionaire. An instructor’s job is to educate, not theorize or speculate. And yet too many of them are too fond of spreading absolute nonsense to make themselves seem smarter than they are.
By that standard I’d never carry my Wilson Combat Custom 1911 because 5 master gunsmiths made it into a custom premium killing machine!!!
That even sounds dumb…
You know I think I’m seeing the light - that is, the logic behind it all.
The net of it is if all your modifications are legal then you’re good to go. Only deal with real issues that you’re actually facing or the your are HIGHLY likely to face based on FACTS. Otherwise you’re battling theories from some self appointed oracle.
If the DA did bring that up your lawyer could counter with an expert’s testimony about how your modifications made it more likely for you to not miss your intended target thus reducing the chances of accidentally hitting an innocent bystander.
Now if your trigger gives you a significantly lighter pull significantly below the range of other defensive carry guns and you happen to have a negligent discharge causing harm to an innocent bystander then a DA might be able to successfully use that modification against you.
They normally don’t field strip a gun when you show it to them. Are you in this country?
Utah/Nevada
Oh, your concerns are supposed to be mine, a Californian
I-80 East over the Sierra is your freedom!
