Hi All, first post here.
Have a question about our interpretations of MA Concealed Carry Gun Laws. I have a MA Type A, Large Capacity License to Carry (LTC). As you may know we here in MA are restricted to a 10-round magazine. MA also has a list of firearms with larger (than 10 round) capacities as well as a list of approved firearms. I have a legal, large capacity, ‘Pre Ban’ Browning High Power 9MM with 13 round magazines. Looking for thoughts out there. I have read the MA laws ‘hundreds’ of times. I believe that I am quite familiar and well versed. It’s up to interpretation: Can I carry this firearm and (13 round) high capacity magazines, in MA? Remember the firearm is Pre-Ban. Thanks
Not a clue, but welcome to our community, we are glad to have you here.
Welcome to the community!
I grew up in Western Mass but left long before I got into firearms. I’ve never heard of a special large capacity license before. Is it available to anyone to get it or does it require having been an LEO or similar?
I did some looking into gun laws in MA a few years ago when I tried to convince my brother who still lives there to purchase one. They seem every bit as convoluted as CA and NY laws. I’d highly recommend consulting a lawyer with MA firearms experience.
Hello and welcome to the community @Robert1382
Hi Robert and welcome. This is a question that is best directed at an actual Massachusetts Criminal Defense attorney. If you’re a member of the USCCA I would advise that you look at the list of our referral attorneys in your state and call one, identify yourself as a member, and ask the question. Most will be happy to talk to you because they know if you ever get in trouble you’ll be calling them back and you are insured.
Welcome
Welcome to the family brother @Robert1382 and we are happy to have you here with us.
Hi Shamrock,
‘Convoluted’ is being nice… You’re on to something. Active and retired Law Enforcement Officers (LEO) can apply to continue to carry large capacity. Incredibly here in MA we have municipalities that will not issue a LTC to active LEOs, who after shift must lock duty firearms in their locker; Boston MA is notorious for this. Each and every individual, MA town or municipality determines licensing in MA. I am not LEO but do have the Type A large capacity LTC (concealed carry). Some towns, if they issue at all, ‘may issue’ (MA legal term) a Sporting License that allows travel (locked in trunk, unloaded) only to and from the range. Type B License allows for open carry only of small capacity. Then we also have FID cards for long guns (rifles and shotguns 10 round or less) only. Will consult attorney and report back. Thank you
I’ve come to recognize something about myself. I have found almost every States who push gun control to be nonsensical. I’ve also found I have 0 desire to be a 2nd Amendment Legend. So I will just say. Ask an attorney would be my answer. Especially for these anti 2A States.
I am in mass, my friend; the simple answer is I would not carry the pre-ban 13 rounds. Ten rounds is the mass law. If you have to defend yourself, you want to make sure there are no questions on whether you are in the right to carry a 13 pre-ban mag.
I follow Mass Law to the Letter.
As mentioned I would ask an attorney and/or simply carry the restricted capacity magazines and be happy I could carry at all, while meanwhile exploring every possible exfil/relocation strategy remotely viable
You could also try Northeastshooters.com Forums
Mass based forum, think there’s an attorney or 10 on there.
Enzo and everyone else, great points. I am a member of USCCA and have contacted a Massachusetts Firearms and Criminal Defense Attorney. Meeting is scheduled and I will report back. In the mean-time looking to relocate my family and I to NH in a month or two after kids graduate from high school. Thank you!!
Agreed! Thank you
Good gameplan!!!
