In states where it is legal, it’s also legal to transport it in your car.
Some states will allow you have a ounce or more in your possession
You were not consuming it, It was not on your person . Your passenger claims the possession of it you can still legally carry your gun.
And even the feds aren’t concerned as far as your gun.
caring it or transporting it isn’t using,
they’re only concerned about if you’re a habitual user.
Jmhao
Because if I don’t add that tagline, everybody thinks they’re being told what to do or worse yet what they can’t do.
If the stuff is legal and especially if you’re in your state it was legally purchased in or prescribed to the person it should be perfectly and if you get into a bunch of crap for it and if it’s legal for the passenger to have it and you get in a bunch of crap for it as long as a doobie isn’t being smoked in the vehicle it should be perfectly ok and if a cop trying to make a name for him or herself says it ain’t get a lawyer and sue the excrement out of the city or county or municipality the cop works for and you will win
Welcome to the fold Denis,
You are right where you are suppose to be
Please consult your State/City’s Laws
What Fly’s , What doesn’t.
Only YOU know what the Law Enforcement in your Community is like
Does this scenario FEEL like it could be a problem where you live?
In New Mexico (Albuquerque) the Jury is out
Plenty of GOOD Cops, some Bad
The BEST advice I heard here is ‘Don’t poke the Bear’ (My take on it)
I don’t drink or drug, I am a Gunner, I follow the rules of Gunning and te road.
As some have said be Grey man. It’s YOUR choice to associate with a
person using drugs/Alcohol
Open container is a No No here even though folks say ‘I keep it in the trunk’
Well you can pull over anytime you wish and take a few swigs.
It’s all a matter of what crap you wish to accept. A Cop finds drugs (legal or not their interpretation is all that matters to them). Leads you down a slippery slope
you prolly don’t wish to go.
If your passenger wishes to it’s still YOUR car—see where most of us are going here?
What’s your CCW worth to you?
What’s your legal right to defend yourself and others getting taken away
because of substances mean to you.
The Law ain’t FAIR
Nobody named Hunter posts here.
Sometimes Cops aren’t FAIR
I Love Leo’s, I’ve had a Level 3 Armed Security License for over (20) years
I have Top Secret ‘Q’ Clearance w/ the DoD for just as long
I will NOT Jeopardize any of that for ‘Recreational drugs-or alcohol’
It can all be taken away in a flash and the chances of getting ANY of them back is slim to none.
BE A GUNNER FIRST.

Well, if you transport alcohol in your trunk, you can just stop and take a swig.
If you drive through town, you could just stop at every bar and have a swig.
Leo needs to enforce and interpret the laws with the intent that they were intended for.
And observe the communities wishes.
If it’s legal for your passenger to possess cannabis, it’s legal for them to possess it in your car while you’re driving it.
The laws for cannabis are similar to possessing and caring alcohol in your vehicle.
The officer may give you a swab test (they have a swab where they can swab the inside of your cheek, and I will tell them that there is THC present ) ( present of THC does not prove intoxication )to see if you consumed any because his concern is that you were consuming cannabis while or before driving
question to all of you, do you search your passengers or even ask your passengers what they have before they get into your vehicle?
I don’t tell my buddy’s I’m carrying a gun when I get in their vehicles and what if he is a felon
Who can’t possess a gun.
Does he now illegally possess a gun and will he be held responsible for my gun in his car?
The question on the form asks
Are you an unlawful user of or addicted to any controlled substance;
Is it lawful to use and possess cannabis in your state?
And an occasional user is not addicted.
If there is a conflict between federal and state law, federal law always prevails.
But yet the fed hasn’t cracked down on any of states who legally allow cannabis.
I believe cannabis is being moved from schedule one to schedule three and that should remove it from even being asked about on the application.
I know, oh my God, stoners will be carrying guns. Pisst drunks already are.
@Whats wrong with his wife or friends? If it’s legally dispersed and prescribed to them it’s no different than any other prescription, and to people who are on kemotherapy and to sick to eat from it it’s the only thing that will stimulate their appetite, can’t be weak while taking the kemp it could be fatal. Maybe you should think before you say such things, God man. Do you try to run over bikers because they are scooter trash to?
Possession of marijuana is not looked at as a serious crime anymore since they legalized it now. They take shoplifting more seriously. Also depends on the state. Also some young or rookie LEOs don’t know or study the laws of the state and end up arresting people for no reason at all. As far as California prop 64:
Overview
Effective November 9, 2016, Proposition 64 legalizes specified personal use and cultivation of marijuana for adults 21 years of age or older; reduces criminal penalties for specified marijuana-related offenses for adults and juveniles; and authorizes resentencing or dismissal and sealing of prior, eligible marijuana-related convictions. The proposition includes provisions on regulation, licensing, and taxation of legalized use.
In my State you can have medical card to smoke. And now the new law is dom’t need the card anymore. Free to use & smoke freely. But the issue is with the FED. By federal law you can not have it period. Stare yes yes, Fed says NO and cant have a firearm or even buy ammo if you use it. in the end Federal law will over see State law. Trick or treat, not sure how the law will look at this. We know what the FEDS say about this.
Aug 9 2023) - A federal appeals court ruled that a decades-old law prohibiting users of illegal drugs from owning firearms was unconstitutional as applied to the case of a marijuana user, the latest fallout from a U.S. Supreme Court ruling last year that expanded gun rights.
