Insurance for Concealed Carry/Liability for Concealed Carry

I reviewed the Delta Defense liability insurance policy, and I see that it covers defense and indemnification for claims of damages for “objectively reasonable” acts of self defense. Three questions:

  1. Where would I find the contractual obligation to provide a defense in criminal law? I don’t see that in the Delta Defense policy - but that seems to be a big part of the USCCA marketing - that a defense will be provided to criminal charges. Please refer me to the coverage documents for that.
  2. I’m concerned about the “objectively reasonable” standard for an act of self defense. I’m sure most people of good faith believe - subjectively - their shoot is reasonable at the time. But, what if later on, a civil or criminal court second guesses - as they tend to do - and determines that the shoot really wasn’t reasonable. Does the insured suddenly find themselves with no insurance and no lawyer?
  3. What about negligent discharges - is that coverage found in the homeowner’s insurance policy? Is that standard or does it have to be specifically written in?

THANKS SO MUCH FOR ANY THOUGHTFUL RESPONSES!

I imagine calling and emailing them most helpful. Their website has some info. I noticed on our member page, it has a section: https://my.usconcealedcarry.com/benefits

Under Membership benefits, right hand side, insurance information. As far as how strong a self defense definition the act contained, I’ve thought about that as well; For that, I try to learn the laws of the state I am in, as some states differ. I try to learn measured response God Forbid I ever encounter a sentinel event.

Story linked below; about just brandishing. I was sure the man who did so would be in severe legal trouble, I think he got lucky in the end. I thought his case was controversial, despite my belief in 2A rights, I think there is a fine line as to when to “draw”:

I think on one side of the line is emotional thinking and the other side is rational thinking.

You should probably have a lawyer NOT with the USCCA review the policy if you have questions. I take the assumption that Delta is an insurance company first and foremost - make the money via premiums, keep the money by not paying liabilities; so if you have to defend yourself be darned certain its as plain as a dog turd in your driveway or you may be on the hook for everything.

This is just a Community where we discuss. I doubt anyone here is willing to answers such questions and provide info that actually should come from Delta Defense.

“Good” way of describing it.

I’ve sometimes wondered, if one owns two different insurance policies, if USCCA chose not to cover, can we then still use our second insurer?

If you can afford more than USCCA you’re doing better than me for sure!

Mr. Tim Schmidt your “premiums” are just that and have me for one questioning why I don’t consider other options.
