I think Polk County Sheriff Grady Judd is misleading people about open carry now being legal in Florida. I have a lot of time on my hands and made a video about it. I don’t know I am allowed to link it but there sheriff more than one stated places you can’t carry openly and he said “Government buildings.” when i heard that the first thing I thought is wow that is overly broad.
Florida Statute 790.06 (12)(a) clearly states the place carry is prohibited.There are some government buildings are on this list there is no blanket ban on carrying in places like City hall as long as you do not try to go into a meeting of the city commission. I am not sure that them actively having a meeting in the commission chamber makes the rest of the building off limits. I don’t know.
The statute with the prohibited places says only one thing about open carry. It says plainly A license issued under this section does not authorize any person to openly carry a handgun or carry a concealed weapon or concealed firearm into. one it is sayingh what the CWAFL does not allow you to carry in those place. Seems to be making the issuance of a license as a predicate. This is from when the license was required to carry concealed. Permitless concealed carry started in 2023 and now we have permitless open or concealed carry.
I don’t have the patience to find this in Florida Statute 790, but don’t forget Florida Statute 0394.458 that prohibits carry in any hospital providing mental health services; which is probably pretty much all of them:
I don’t know if there are any other statutes that might be referenced in 790 or just stand alone under a different statute. These not so well know statures alone make me question me personally open carrying, other than hunting or fishing.
Edit: a search of 790.06 for 394 regards concealed carry license rejection for mental health but no mention of hospital carry.
Just because a Hospital receives these kinds of patients and may have a locked down unit that treats them it does not bar the entire hospital or property. I will look more into it when I have time this week.
394.458(1)(b)7 is the statute and i’ll be damned it does covere grounds. Definitly needs to specify locked down units imo but until I find more clarity I will err on the side of caution. Thanks for pointing it out. and Florida Statute 810.09 addresses trespass on property other than a structure or conveyance. My contention is there is nothing in 810 anywhere that says a posted sign means I have to not enter while carrying concealed. I also feel if a business requires I disarm and I do disarm then I get assaulted , dtabbed or shot. then they should foot the bill. (Not that anyones service or product is good enough to make me disarm. I’d rather find another business to give my money too.)

Everywhere I’ve ever seen a statute referenced on a business “No Firearms Sign” in Florida it never seems directly applicable to the circumstances. Their tactic is probably effective in that responsible firearm carriers don’t have every statute memorized and some may take the sign as “more legally powerful” when it has a statute printed on it. I’m sure it stops criminal activity from entering their business - (sarcasm)
I 100% agree with you. I was between a rock and a hard place needing some hydrauic steering fluid for a boat and they were the only place that had it immediately available.
Well, they’re idiots. Without exception, the boaters I’ve known over the years are conservative, and almost always armed. We boat armed. We’re not stupid. You’re out there on the ocean, no one else for miles, and God-knows-who with what criminal background could come by and want your boat or worse. And, boats are expensive, meaning, you need good income, which means you work and pay for your own stuff, which likely means you’re politically conservative, which usually seems to go along with supporting the Constitution .
Worst Marine lost my business years ago. Amazon has just about everything I’ve ever needed for the boat, at better prices, with better selection. Walmart even has a decent boat area for basics like flares, fluids and lines, or if you need a life jacket for an unexpected guest.
