No Robert, It was a good thread/topic that you started and still is, it just shows how someone’s ignorance shows up.
A dangerous or deadly weapon is whatever local law enforcement or prosecute claim it is if they decide to prosecute you for what they conclude is a criminal act.
That is what I thought @Nathan57 was talking about, still I don’t think it should be called a deadly weapon by us. It’s all about how it is being used.
They sure can be. And? It’s no revelation that firearms are not the only deadly weapon out there.
I have been posting here a long time. I double dog dare you to find any instance anywhere of me ever advocating for tighter controls. What on earth led you to asking that question?
Ignorance?
So, your position is that firearms are NOT deadly weapons?
Okay
What IS a deadly weapon, then?
A firearm becomes a deadly weapon when it is used to murder.
For which state is that your assertion? Let’s check
Here is one reference, you may provide counter evidence if you like
Cornell law says
“ Rather, the deadly nature of the weapon is automatically assumed. Firearms are the most common deadly weapons”
But let’s get more specific and start looking at state statutes and cases
What state only considers the firearm a deadly weapon when it is used for murder? Is that via statute or case law?
Or we could go another direction: what training have you taken that taught firearms are not deadly weapons?
Or like @Mark697 says
Anything from a knife to a baseball bat to a 2×4 is a deadly weapon or they can used as a tool, just a gun is a tool. But before anything that could be used as a weapon, there is one thing in common that each of them have, it takes human effort for it to become a deadly weapon.
I might as well get you involved.
If the prosecuting attorney says you used your deadly weapon to shoot the man you were defending yourself against and your lawyer says you were using your life-saving tool to save your own life and the life of those around you, who are you going to agree with?
I’m very sorry to hear that you believe shooting someone with a deadly weapon is always illegal and never justified.
I forgive you. Yea I would never do that. I would only shoot someone to save lives with a weapon/tool designed to save lives. So we can MAGA.
You, and all who are considering carrying a deadly weapon, really do need to acknowledge the responsibilities of carrying a deadly weapon
Let’s see what not only the laws say (which is that a firearm is a deadly weapon) but let’s see what some industry experts say
Tom Givens says the pistol you carry is a deadly weapon
Concealed Carry Class, page 19 shown
How about massad ayoob in the book literally called deadly force
“a gun, obviously, is a deadly weapon”
Let’s take an example state.
Florida. Law firm reference:
Common Examples of Deadly Weapons
Deadly weapons can include, but are not limited to:
*** Firearms**
- Knives
- Blunt objects like bats or clubs
- Vehicles used to threaten or injure
- Any object used in a manner likely to cause serious injury
Understanding what constitutes a deadly weapon is crucial for anyone facing assault charges. The law does not limit deadly weapons to conventional items like guns or knives. Even everyday objects can be classified as deadly weapons if they are used in a manner that can cause significant harm.
Firearms
Firearms are perhaps the most commonly recognized deadly weapons. Under Florida law, the use of a firearm in an assault significantly elevates the severity of the charges. According to Florida Statute 775.087, the bond amount for aggravated assault with a firearm must be set by a judge at the first appearance.
Would you like to provide a source supporting your claim that firearms are not deadly weapons?
I’m sure mas ayoob, the USCCA, the lawyers and law firms above, Tom Givens, and all the rest of the professionals would appreciate it if you corrected them
That is my whole point. I am sure they would call it a life saving tool if they thought we knew what they were talking about. I don’t know what they are thinking. Do you? Does anybody who’s reading this?
It’s called a deadly weapon because it is, and because this is an absolutely necessary concept to understand if you are going to be responsibly armed.
But, hey, let me blow your mind…it can be more than one thing
A deadly weapon can also be a life saving tool.
Taking a life can simultaneously save a life.
But pretending that a deadly weapon is not a deadly weapon is wrong and dangerous
Like I mentioned before, what is one thing in common that all these items need to become a deadly weapon, that is human effort.
