I agree. The key would be, what was McGlockton saying in that moment? He had just assaulted Djeka, and if he was threatening him, even while taking steps away from Djeka. I agree, with his attitude, Djeka shouldn’t have been carrying a gun, and he shouldn’t have approached the woman over the parking spot. Now, it’s up to the jury to decide if that was worth an assault, and if Djeka and his attorney can make them believe his life was in imminent danger.
The sad part is, that a man died over a parking spot. And to @ZOOMBATT, unless Djeka was shouting racist remarks at them, or is a known racist, then race had nothing to do with this case.
All I can say is that if his atty manages to get a not guilty verdict we need to be sure and get him recruited for the USCCA network of atty’s.
Right now I just can’t see how the shooting is in any way justifiable.
I simply can’t get past the fact that McGlockton was retreating, in a completely non threatening posture and starting to turn away when the first shot was fired.
To me that was shooting in retaliation for the shove, not self defense.
The article does state that it was an unarmed black man who was shot and killed. I’ve requested in pervious comment that the racial part of the discussion be dropped by everyone as this was not what your original question was about.
I watched most of the trial to this point over the last two days. For those of you who’ve never sat through a trial it’s like watching paint dry.
The defense spent most of today trying to attack the evidence and put on an “expert” who spent hours going on about McGlockton being high on MDMA.
I don’t find any of it persuasive and Drejka certainly had no way of knowing he was high or that a side effect of the drug could be aggression.
I still cannot find a justifiable use of Deadly force on his part. To me it all boils down to the fact that he shot McGlockton after M had retreated back to the car and was turning away.
The track of the bullet confirms he was not facing Drejka when he was shot, he’d partially turned to his right, towards the store entrance before being hit as the bullet transected both lungs and the heart.
At this point I think the best he can hope for is a hung jury.
It was brought up but I don’t think anyone can without bias accept that he was blading rather than turning away particularly since he’d taken two or three steps back already and having backed into the car, given his body position he was left with turning and moving to his right or charging back at Drejka.
If you’ll go to the 1:50 mark or there abouts in this video and look at his feet, his feet are turned toward the camera, not towards Drejka further cementing that he was turning away rather than preparing to launch another attack as well.
I really think a person has to have a clear bias given the evidence to support Drejka’s claim of self defense.
I have an admitted bias for the defender in these cases and I just can’t see this as anything other than murder
There are two or three seconds between the time he draws and puts the gun on McGlockton before he fires so he had ample time to assess the situation and see that the threat had ceased to exist as soon as McGlockton began to retreat.
His only reasonable shot at self defense, is, making the musty believe he was dazed after hitting the ground. We have the benefit of the camera, and pausing, slow motion, etc. He shouldn’t have approached the woman about the parking spot, but, McGlockton shouldn’t have assaulted him either. It will really depend on what he, and his attorney can convince the jury. Like I said in an earlier post, if only we had audio with the video. What McGlockton, and Djeka said as it unfolded would make the difference in how the jury looks at it.
Totally different cases. There was a clear immediate, ongoing threat of grave bodily harm or death in the Zimmerman case and he had communicated loudly his desire to escape which was prevented by Martin.
Drejka faced no such immediate or imminent threat. As soon as he drew McGlockton backed off and was turning away when shot.
I doubt it had much to do with the verdict. There simply was no lawful use of force, much less deadly force once McGlockton started retreating and certainly not after he started to turn away.
That might have been the “icing on the cake” so to speak but it didn’t change the key facts of this incident.
I just watched the video wow! The guy started to show signs that he knew he messed up when the guy he pushed started reaching for his weapon. Never pull your weapon unless you plan on squeezing a round off. The man on the ground had no way to protect himself after him hitting the ground. Put your self in his position he was at that point at the hand of the attacker, now saying that this whole incident Could have been avoided by not saying anything about the parking spot. I agree the man should have waited to pull his weapon and had the attacker arrested for assault . If he was that unhappy about those ppl parking in a handicap spot then call the police. I think this man made his mistake by confronting those people and it escalated from that point. Both have broken the law . One the attacker for assaulting someone over a parking spot and the other person for shooting someone over a parking spot. Simple two wrongs don’t make a right sad sad , this had to happen because of two hot headed people.
I watched the video numerous times. At the risk of being a Monday morning quarterback, I’d say he didn’t meet to pull his gun or shoot. Since the jury found him guilty of manslaughter I guess he won’t have to worry about where he’s going to sleep for a few years.He definitely did not represent the gun community very well.

If you look closely at the video you can even see McGlockton’s feet turned towards the camera rather than towards Drejka at the time the shot was fired.
Drejka shot not to stop an attack but in retaliation for an attack that was already over and as a result he’ll spend the next 20-30 years of his life, assuming he lives that long, in a maximum security prison.
Over 90% of successful DGU’s don’t even involve a shot being fired.
So sad all this over a parking spot ! Well this is clear for everyone to avoid conflict don’t look for it ! Both of these men lost , one his life the other his freedom over a parking spot and many bad decisions . I hope many people learn from this , how will squeezing off a round will change my life? So sad so sad to see two men’s life’s destroyed over being hot headed.
