Big difference between driving drunk (illegal) and having a drink at home (legal). I’m of the opinion if you’re going to analyze your right to defend yourself in your own home because you’ve had a drink, I can’t agree. What are you saying, oops, I’ve had a drink, so come in, rape the women, take my stiff, then kill me. Guess I deserve it, I had a drink! Some will say you need to think of the legal implications. Guess what, you ain’t gonna be thinking about them when you and your family dead! Granted, you need to be able to assess the threat and use reasonable judgment, but to me, if someone is lucid enough to make a reasonable decision, they have every right to defend themselves and family. Although I will agree that if your goal is to get falling down drunk, keep the gun locked up.

Honestly, I tend to take my edc off when I’m drinking.

But I have a huge number of bladed weapons around the home, so an invader may not get shot,…

But what does happen is likely to be far worse!

Sorry, got to be more specific on replies. My comments are directed totally to the topic, not directed at any other posts. You’re right, grey areas galore. My main point is the topic refers to a few drinks. I not a drinker anymore, but in my younger days would go out for a few. Can’t go out for dinner without seeing people having a few drinks. Most get home just fine and are under the legal limit. This and only this was my reference. I also stated if you’re drinking to get drunk, leave your weapon locked up. What my issue is with the DA’s etc. who will use a drink, a painkiller, or whatever to discredit what otherwise are sane and logical responses to a situation by an individual they don’t like, ie gun owners.

However, if your home had not been invaded you would not have been handling a firearm. Other factors come into play here: Castle Doctrine and Duty to Retreat to name a couple. Factors will vary considerably state to state. In NC, for example, we may legally assume that if a person enters our home without our permission that they intend on killing us, and we may act accordingly. As many facets as there are to an in-home shooting, adding in alcohol consumption is certainly not going to make things go any smoother.

And actually I’m glad that @NavalAV8R_USA brought this dilemma for discussion.

This is always questionable, how much alcohol in your blood is OK to do certain things. And everything depends on point of view.
You can be drunk and feel fine, drive your car, shoot the firearm without any problems… but it’s bad
or
You can have one beer and have alcohol level close to “0” and you can get into the trouble because you used the firearm being intoxicated.

Whatever you do it always looks bad…

It’s situations like this that make me worry about the criminal charge exclusion in USCCA’s contract. Some arrogant cop can charge you. Granted the charge most likely won’t hold up. But will you get dropped? Just like if a bullet goes through someone or you miss and it flies into your neighbors house. They can technically charge you with endangerment. Will you get dropped from the crimson act?
