I know how some of us Train—we speak of it all the time (I do so in the hopes that IF some Sh!t hits the fan for any of you maybe they remember one of the things we say (Memorize the 4 rules, DON’T HESITATE, Train, Train, Train etc sinks in at the right time and best of all scenarios is you avoid Armed conflict altogether, Second place (and not to shabby) YOU SURVIVE THE GUNFIGHT). The last place we won’t even venture there…It’s more important than ever today we keep our sh!t wired tight at all times. You don’t have to be a Paranoid Scaredy cat but Awake and Aware is a great start.

According to the facts you stated the gentleman could not legally use force against the screaming individual. If he were to draw his weapon in this case he would likely be arrested for brandishing depending on the laws in the city and state of this theoretical exercise.

Is the couple in imminent threat of danger? Does the screaming individual have the means, motive and opportunity to bring violence on the couple. To use force you need to believe your life or the life of the person you’re with is truly in danger. Means - he could use fists or have a hidden weapon Motive - this one is questionable is screaming god is great in another language be considered motive? In this case probably not. Opportunity - the distance isn’t detailed but I would guess the couple could continue on their way unscathed; but again not enough is detailed. Remember if you are going to use deadly force you will be legally judged on the below 5 elements:

1-Innocence of your actions in the altercation.

2-Imminence of the threat of death or serious physical injury.

3-Proportionality of force. Is your force proportional to the imminent threat you are facing.

4-Avoidance can you have safely avoided this fight by continuing on your way?

5-Reasonableness, this is decided by what the previous 4 elements are showing and then will those actions be seen as reasonable actions to a reasonable man faced with the same situation.

Just because someone is yelling at you and it causes you concern you cannot take up physical violence against them until there is an apparent physical threat of death or serious bodily injury. I fully understand not wanting to be a victim or waiting to be a victim but it has to be clear that you or your spouse is in jeopardy of death or serious physical harm. But this is how law enforcement and the courts will look at this. There is a very fine balance between being justified and guilty.

In Utah I don’t need to wait until I don’t need to wait until I’m under Attack, I only need to “if the individual reasonably believes that force is necessary to prevent death or serious bodily injury to the individual or another individual as a result of imminent use of unlawful force, or to prevent the commission of a forcible felony.”.

76-2-402. Force in defense of person – Forcible felony defined.
(1) As used in this section:
(a) “Forcible felony” means aggravated assault, mayhem, aggravated murder, murder, manslaughter, kidnapping and aggravated kidnapping, rape, forcible sodomy, rape of a child, object rape, object rape of a child, sexual abuse of a child, aggravated sexual abuse of a child, and aggravated sexual assault as defined in Chapter 5, Offenses Against the Individual, and arson, robbery, and burglary as defined in Chapter 6, Offenses Against Property.
(b) “Forcible felony” includes any other felony offense that involves the use of force or violence against an individual that poses a substantial danger of death or serious bodily injury.
(c) “Forcible felony” does not include burglary of a vehicle, as defined in Section 76-6-204, unless the vehicle is occupied at the time unlawful entry is made or attempted.
(2)
(a) An individual is justified in threatening or using force against another individual when and to the extent that the individual reasonably believes that force or a threat of force is necessary to defend the individual or another individual against the imminent use of unlawful force.
(b) An individual is justified in using force intended or likely to cause death or serious bodily injury only if the individual reasonably believes that force is necessary to prevent death or serious bodily injury to the individual or another individual as a result of imminent use of unlawful force, or to prevent the commission of a forcible felony.

Let’s add to it. There is no duty to retreat in Colorado. The couple are both disabled, the man has one good leg and the wife is on bottled oxygen. They couldn’t run if they had to. The assailant is in his mid twenties and well built. As he approaches, he is extremely agitated, still shouting the same and has his hand inside his jacket. The gold standard is, do you and your wife feel that you are fearing of serious bodily harm or death? The perp is quickly approaching the seven foot mark. And let’s say that the old mas has given the perp several commands to not approach.
And I’ll be honest, I’m a retired detective. A few years ago I would have agreed with most of you, but especially since the events that have taken place just after I posted this, I have doubts. I’m reminded of a saying we had in the military," Better to be judged by twelve then carried by six." In todays world we all better give some real thought to things like this.

There is no Left of Bang with these killers! They are on their mission from God, that can’t be stopped by side stepping! It is reasonable to believe you will die!

USCCA has great classes. Great advice. Unfortunately times are changing faster then the training and the laws. Ask any vet that’s served time in a Muslim country if there is much difference between Kabul and Dearborn these days? Or is it getting hard to tell. Look at the EU and what’s happening their.
