**There’s been a lot of buzz about the recent court decision, leading to a wave of questions about what the NFA process will look like moving forward.
A federal judge ruled on August 5, 2026 that certain NFA registration and approval requirements can no longer be enforced against parties covered by the case, but this is not a full repeal of the NFA and does not apply to every buyer or every state. Because the ruling is new, limited in scope, and likely to be challenged, Capitol Armory’s transfer process is unchanged for now. We will continue using the established ATF transfer process for new orders, pending Form 4 applications will continue through the normal approval process, and we will not skip a required step until we have clear written guidance from the ATF and approval from our counsel.
If your Form 4 is already pending, no action is needed. If you’ve paid but haven’t submitted yet, you can ask us to submit now, hold your item while we wait for clearer guidance, or transfer to another dealer. If you already own a registered suppressor, SBR, or SBS, nothing about your existing registration changes.**
Maybe there’s some residual effect that could occur as a result of this ruling that I’m not able to see yet but as of right now I’m thinking this is some bull. For anyone to claim the nfa dead is at best an overstatement and even could be considered click bait. The Gun control act is like the mother of the nfa and THAT should be the target. I’m disappointed, again!
Technically, the NFA spawned the GCA 30 some years later….
Both of them need to be eliminated for sure,…. They’ve been eroding our 2A rights for 90+ years with tiny little baby steps, this is a MASSIVE win to reclaim them.
So, here’s what I’m thinking. I just need to register my sbr with my gun store by filling out the same background check form I would for a gun. This should cost me like $10 I think. Once it’s through boom! I’m good!! No need to carry around a stamp in the stock. No registry. Should take 10 min. Does that sound right?
Now we have to wait until ATF gives guidance how to move forward. SilencerCo said you can buy a suppressor and they will ship to your FFL where it will sit until guidance is given.
