I don’t normally share a full page of The Concealed Carry Magazine, but I think this topic had some confusion and this article definitely clears it up. (Click on the picture to make it large enough to read. )
As I see it the only thing a RED FLAG LAW will do is cause a lot of grief for “good guys and gals with a gun”. If you have a neighbor or fellow employee who may have a perceived grudge against you, you could be getting a visit from your local constable - not always a good thing. The left is pushing the issue as a means to gun confiscation. Any and all chances to vote against the adoption of an RFL should be in the negative. If you know of someone making threats of violence it would be best to alert the proper authorities and hope they have the sense to ‘investigate before incarcerate’.
Not really clear. Stand by to stand by is what I took from the article. How about an explanation of some of the obstacles you are facing to implement this type of coverage and what you are considering. Thanks!
I live California where the Democrats pass laws without a vote. I think our system is rigged in California “Who Votes To Raise Taxes?? It happens here! We already have the RFL here, it is totally against the Constitution, you are guilty until you prove yourself innocent. There should be a consequence if someone “Bears False Witness on thy Neighbor” , that’s also against one of the Ten Commandments . The Forefathers wrote the Constitution in stone to abide by them. Just like when Our Father God give the Ten Commandments to Moses, you can’t change them to fit your needs. The Constitution wasn’t written for the government, it was written “For the People”, it was Never theirs to give away.
We really should have a amendment to our USCCA coverage for REDFLAG protection. THIS IS A GUILTY UNTIL PROVEN INNOCENT LAW. ITS A BACKWARDS LAW! AND WE DESPERATELY NEED LEGAL DEFENSE IF IT COMES UPON US BY SOME CUCKOO SPOUSE OR SOME JEALOUS OR INSECURE LIBERAL RELATIVES THAT THINKS ITS THEIR DUTY TO MAKE A FALSE ACCUSATION!

The Official Red Flag protection verbiage is in the works. As with all things legal-related, I am not able to give details until it is finalized. Anything else I could provide at this point would be speculation. And speculation just increases frustration.
As soon as I have the details, I’ll be broadcasting them here.
Any idea on ETA on red flag law coverage? I tried calling USCCA and got a scripted response about resources available with information about dealing with ERPO and coverage will be determined on a case by case basis.
I live in a state where red flag laws were fat tracked into signing with less than 24 hours notice on vote. They go into effect on Jan 2020.
I will always encourage people to make sure they have the product that best serves their needs, @Oliver_L. I do believe that the USCCA offers the best product out there for the majority of responsibly armed Americans and we are always improving our memberships.
Hi Dawn, it sounds as though this grant for ERPO protection is separate from the existing legal protection offered by USCCA membership. Is this reading correct? Also, who decides the criteria for “unmeritorious prosecution” and can you offer any insight into that standard?
I have very recently been in a heated discussion with someone about “Red flag laws”. Up until now we have been friends but I am not so sure it will last.
This person is very anti gun (very personal reasons) and thinks all these laws do is allow the police to keep guns out of the hands of the mentally ill.
I calmly explained it was not about guns but about guns as much as it was about giving up Rights.
I hate to say this but this person doesn’t care what it costs as long as it could save one child from being shot while at school. There was no longer a calm discussion it was all about guns and how they are bad and not needed by anyone.
I was told times have changed and the Constitution and Bill of Rights are out dated and we no longer need them.
I did invite them to read the Constitution and Bill of Rights to understand what we the people are being asked to give up. That is when the conversation ended (and perhaps our friendship as well).
Point out to your friend that what RFL’s actually allow is anyone with a grudge, or just a sick sense of humor can make a complaint and have you swatted at 3am, at school, work, or driving down the road even if you don’t own a firearm at all.
I believe sooner or later that the Constitutionality of “Red Flag Laws” is going to end up before the Supreme Court and they will agree that they do in fact violate the Bill of Rights.
But it will take time as it did to finally get the Heller decision affirming the 2nd Amendment as an individual right.
As frustrating as it is we need to be patient, continue contacting our elected politicians and calmly letting them know our stance on these laws and our willingness to either vote them in or out of office.
Be patient friends, It is coming, Rome wasn’t built in a day, lol.
