How can i own a firearm if my wife has a felony charge from over 20 years ago?

You can own a firearm. your wife can NOT in be in control or possession of this firearm at ANY time. That means locked away in a place (gun safe) where she has no access to it if itā€™s not on you. And donā€™t for a second think of leaving a gun in the glove compartment of your car when she stays in the car and you walk away for a few minutesā€¦

Orrrrrr, talk to a Lawyer to see if her record can be expunged but that takes money, usually thousands of $$$$s.

Orrrrrr, check to see if the records still exist or are active. Many police departments have REALLY bad records keeping and over 20 years many, especially small towns, didnā€™t even have computerized records and many records have been ā€œlostā€ over the years. A background check will find the record if itā€™s findable. You can get it done only for about $30.

Her record pulls up. And i have been looking into gun safes, i dont own a gun yet but i want to. I just want to be prepared and responsible,And i definitely plan on having it in the safe when not on my person.
Im researching construcive possession so i will be equipped the best way i can.
Im in texas so im trying to figure out the differences between state and federal laws on this matter

Expungement might be an option depending on what the felony was, her age at the time, clean record since etc. Might be worth talking to an attorney about it. Itā€™s usually a set fee and they do all the paperwork and court appearances etc.

She was in high school when it happened around 2003, clean record since, but it was 2 counts and 1 was deferred i believe. I think one was assault and the other was drugs on school property or something. She finished probation in 2009.
But we are 40 now, no drugs or anything for the last 12 years or so. We are active in church, good reputations.i just want to excercise my rights without putting her at risk.

I get it. We all do stupid stuff when young, some pay worse than others. Yep, a lawyer might be able to help you. The consolation is usually free to get started and they normally guarantee their work. Iā€™d start there.

The only reason you would need to worry about federal is if her conviction was on a federal level. Being here in Texas, you have a little more flexibility in what you can do as opposed to some other states.

STRONG RECOMMENDATION: Pull up chapter 46 of the Texas Penal Code and READ IT. Then read it again. It spells out exactly what she CANNOT do as a convicted felon and what you CANNOT do as a citizen legally allowed to possess a firearm.

Expensive. Time consuming. Possibly not an option depending on her crime. WORTH THE EFFORT, if you can afford it.

Start with your stateā€™s laws part of the USCCA reciprocity page which usually states what you need to know for your state, TX.

Then for federal law you might have to use a search engine, or its AI feature like for Bing it has Copilot, that drills down to your specific question.

Which, you might have to adjust, or simplify, to one, or fewer parts. A more complex question might not yield the results you seek at once but, in bites.

This may be splitting hairā€™s here but is the ā€˜Chargeā€™
an ARREST or ā€˜CONVICTIONā€™ Huge difference. I donā€™t need to know
this is for YOUR information.
The reason I ask is I had an ARREST CHARGE leveled against me
in New York City back in the day. (didnā€™t know about it/wasnā€™t told)
Fortunately I was working in Colorado @ the time of the false charge and living in New Mexico
(I bought a house here a couple of years before and itā€™s listed as my primary residence).
ALL ties to NYC were cut Driverā€™s Lic, Insurance, etc.
The person I was working for (J. Hetfield) vouched for me that I was on his Ranch three months before and (6) months after (he didnā€™t have to, heā€™s just a Stand-up guy who hates Injustice). I never left his side (I mean not to the bathroom andā€¦oh, nevermind! :crazy_face:)
I donā€™t need to know the charge but mine was Embezzlement over $25,000 !) @ a place I never heard of in a Borough I never Lived in @ a Job I never Worked in (Staten Island). I had to Google it. to see what this business was.
I hired a Lawyer and she said it was unnecessary to pay her for this (after I came out of my coma ) she did an hours work over the phone and cleaned it all up.
I mention all this to add She told me ā€˜Chargesā€™ drop away after a time if itā€™s not a Serious Felony. (Injury/Death/ Violence) and if the Violated DROP THE CHARGES (without telling the accused it could be a 'NOLO CONTENDE"? I think she said. She also said often times the Charge is dropped because the offended get what they want with the charge: Person arrested, Fired from a job etc and donā€™t wish to pursue it further. They were being spiteful without being overly spiteful.
If the Charge is just a charge she can go to the County clerk a for a few bucks get a Stamped Copy of 'NO CONVICTION from a Judge and POOF! it all goes awayā€¦
