An unnerving encounter

Hello,

A friend of mine recently encountered a man in a park who exposed himself to her. He called out to her, used extremely foul language, and walked towards her. She ran away and is fortunately safe, but she is pretty shaken by the incident.

Can anyone recall an similar incident where a female was able to legally use a firearm in a similar situation??

It was not a life or death situation and she was able to get away so the best she can do is report it to the police. I hope she is OK. I don’t know of any situation where a perp was close enough to rape someone but I think in that situation she would be justified in using self defense.

Nothing specific comes to mind. The foul language, walking towards her, exposing himself do not constitute a life threatening situation where a firearm is needed to protect her life. If he has a knife or gun himself, she has every right to stop the threat in any manner she sees fit.

Every woman should have some form of self defense training especially if she is habitually out somewhere on her own. Study up on Karate or Kem Po and kick his walnuts up into his watch pocket. That will solve his problem.

Doesn’t seem to be a situation you can legally use a firearm.

None that I’m aware of.

I wasn’t there so not sure if it would be justified.

My daughter has pepper spray :white_check_mark: and taser :white_check_mark:
( @Larry130 what’s CS gas pellet?) but to deploy those means she’s in close proximity to the pervert. Not ideal.
Risk of sexually assault or grave bodily harm!
Did it happen at nighttime when risk is even greater?

CS is basically tear gas. It can be deployed from a CO2 charged “pistol” holding 6-8 pellets, with an effective range of 60’. Generally sold for around $275. No permit or license required.

Thank you all for the helpful feedback. I feel that if perps like had a greater fear of being shot, they might think twice. An armed society is a polite society, and things are very impolite now…

Fortunately this was in the middle of the day and my friend is going to carry less-lethal protection (pepper spray). Sabre even makes one that has a GPS component to it.

This and what @Larry130 said! The situation would not be a justifiable use deadly force however both of these guys have the correct answer for the situation.

I would definitely recommend women carry firearms though but honestly…I would recommend pretty much everyone carry firearms lol

I would rather call it being responsibly armed. Carrying a firearm and being responsibly armed…. not the same.

I don’t see it anywhere in Utah law where it allows me to use force against a flasher. Maybe the Stand Your ground plus the guy yelling/closing on you, Rape might make a case but to me, run away and call the cops is probably the right answer.

76-2-402. Force in defense of person – Forcible felony defined.

(1) As used in this section:

(a) “Forcible felony” means aggravated assault, mayhem, aggravated murder, murder, manslaughter, kidnapping and aggravated kidnapping, rape, forcible sodomy, rape of a child, object rape, object rape of a child, sexual abuse of a child, aggravated sexual abuse of a child, and aggravated sexual assault as defined in Chapter 5, Offenses Against the Individual, and arson, robbery, and burglary as defined in Chapter 6, Offenses Against Property.

(b) “Forcible felony” includes any other felony offense that involves the use of force or violence against an individual that poses a substantial danger of death or serious bodily injury.

(c) “Forcible felony” does not include burglary of a vehicle, as defined in Section 76-6-204, unless the vehicle is occupied at the time unlawful entry is made or attempted.

(2)
(a) An individual is justified in threatening or using force against another individual when and to the extent that the individual reasonably believes that force or a threat of force is necessary to defend the individual or another individual against the imminent use of unlawful force.
(b) An individual is justified in using force intended or likely to cause death or serious bodily injury only if the individual reasonably believes that force is necessary to prevent death or serious bodily injury to the individual or another individual as a result of imminent use of unlawful force, or to prevent the commission of a forcible felony.
