Every situation is going to be different and you’ll have only seconds, if that, to decide a course of action. Is the guy merely brandishing for intimidation or is he getting ready to draw? If you respond in like to mere intimidation you may be initiating an OK Corral. If you can, back away. If his demeanor and body language indicate a draw I will not wait to react. I really don’t give a flip about the law and supposed brandishing, especially if I’m with family that could become victims. If he fails to respond in like and backs off, great. But if he insists on going for his weapon you have only one option. Finally, regardless of which way it goes you call 911 and USCCA. You always want to be the first one on record to place a report.

In doing so he has made his ability of using lethal force apparent and immediate. Unbeknownst to him, he is now in a gun fight.

I agree completely, but maybe you missed the part of this scenario where the area involved is not known for criminal activity so would generally be considered relatively safe.
If one takes the position of not going anywhere bad things may happen, and also accepts that bad things can happen anywhere, the only choice left is to nail the doors shut and never go anywhere ever again.

I 100% agree, but like I posted on another thread yesterday. I was simply walking down Main Street in downtown Salt Lake City, in front of the Wells Fargo Corporate Office, people everywhere. The guy was coming up the sidewalk. My Spidey Sense radar didn’t blip it Screamed “That Guy”. I guess what I’m saying is, at least where I live, the only way to be sanitary would be wrapped in a blanket under my bed, then some bastard would probably break in…

Well, @Mike164 , it’s a sad comment on the state of our cities these days.

I think many of us who CC regularly accept the idea that bad people can show up anywhere. The trick to avoidance (without becoming a hermit) is to assess ‘likelihood’ and ‘probability’ rather than ‘possibility’.

Absolutely.

Problem is, people like that can be found pretty much anywhere that people can be found. I don’t think there is such a place as “violent crime can not happen here”.

The scenario at hand probably happens more than a few times every day somewhere in the US. I can only answer for Texas and my local area.

Texas is a Stand Your Ground state. You do not have to tuck tail and run if someone tries this on you. Here in Texas, if he brandishes his weapon first - he lifts his shirt to reveal a pistol stuck in his waistband - the intent of bodily harm is established. Your life and the life of your partner are being threatened. Letting him know you are armed and ready to conduct business is within your right to life, liberty and the pursuit of happiness. Make sure you have video evidence. He could tuck and run, dump his weapon somewhere, call the police and have you arrested for brandishing your weapon, threatening him. It would be your word against his and you are the one with a weapon. It can happen because the criminal element has more rights than we do.

No easy way to answer this one.

Which leads to an important point…if someone brandishes/threatens/whatever word like that, call 911 and report it as soon as you can safely do so

This is true.

Equally true is that there are some areas where it definitely is more likely to happen. Spidey sense tells me “avoid those spots”.

If I didn’t think he was going to shoot me I would probably give him the 40 bucks in my wallet and tell him to have a nice day. If I thought he was going to shoot me I would shoot him before he had a chance. I would not let him see my gun until I drew it. I he does not make a move to draw I would let him walk away and I would call police.

That is commendable of you, Robert. It speaks to a generous and compassionate spirit.

Speaking only for myself, I have spent too many decades of my life having to treat $40 as a major expenditure. If it was for a “want” rather than a “need”, it was a save-up-for-it deal. I have worked too long and too hard for what I have to just give it away to a thug just because he wants it.

My experience with petty thieves and muggers has lead me to believe that they are just short of pocket cash but too lazy to earn any. They’re not all Jean val Jean, stealing a loaf of bread to feed his starving children. Mostly they are wanting money for beer and smokes. Not my responsibility.

Not that I am heartless towards those truly in need but, much like the Lord, I am more likely to help those who help themselves.
