More importantly, gun control violates our Virginia Constitution, Article I, Section 13:

That a well regulated militia, composed of the body of the people, trained to arms, is the proper, natural, and safe defense of a free state, therefore, the right of the people to keep and bear arms shall not be infringed; that standing armies, in time of peace, should be avoided as dangerous to liberty; and that in all cases the military should be under strict subordination to, and governed by, the civil power.

that is a fair constitutional point, and Article I, Section 13 is definitely part of this debate. At the same time, the real issue is whether a specific law is an actual infringement or a regulation that can still survive constitutional review. I think any proposal should be judged carefully on its exact language and impact, not just on the general label of “gun control.”

Well, the impact of at least a few of the Virginia laws she signed is to retroactively criminalize a previously legal right to an activity or ownership - patently unconstitutional and illegal. Others are unconstitutional based on the infringement of our RKBA.

I just keep falling back to “shall not be infringed” and seeing things that were legal suddenly become illegal sounds like infringement to me.

Waiting to see if RI’s latest comes to fruition, making possession of formerly grandfathered guns illegal. Well, if the primary job of the executive branch is to enforce the law of the land, and the US Constitution is the Supreme law of the land, then the executive branch (i.e. the DOJ) absolutely needs to step in when a clear violation of the Supreme law of the land is taking place.

SCOTUS can’t do something until someone sues someone else.

The judges will decide in the end, but POTUS is just bringing the chance for them to hear it.
