The Federal Law is very clear that it supersedes ALL state law, as it pertains to firearms. Even the ATF agrees. I see no reason for insane over caution just because one MIGHT get in trouble in a fashion that I can’t even comprehend. How on God’s earth would they even find out. A random search of your U-HAUL???
Caution is good. Paranoia and irrational fears are not. Again, in cases like this I ask, show me incidents proving that law abiding folks have gotten in trouble while moving and following the rules at a Federal level. Unless it’s a common problem, it’s a just a statistically insignificant possibility. Probably a much higher chance than I’ll die in an horrible car crash while going shopping at the supermarket. Still will go anyway.
Ammo and magazines are a different story and are not covered, and if they are a small amount they can just ship them to themselves to the news address. I have no such option because of quantity, so in the moving container they go, again, NEVER been an issue.
So one more time, dozens of moves, no felonies committed since I’m in full compliance with Federal Law and only transiting through states along the way. If some local authority ever decides to give me trouble, we’ll figure it out in court since I’m not cowering to some illicit local BS. And on issues like this I’ll take my direction from my attorney (who absolutely agrees with me), the actual text of Federal Law and the opinion of the ATF on the matter. Thanks👍
They have found out by coming up with a reason to search the vehicle. I am again speaking more generally than in this exact case (who knows who will search and find this thread, and when, for what states) where the states being traveled through are good. NJ, NY, CA, and the like, are more worrisome.
People have absolutely been arrested and charged with felonies even when they had the protection of the federal law.
This is straight from Tom Grieve in the Protector Academy
If you possess a firearm in a state where possession of that firearm is illegal, you may be arrested and charged (and according to your link, you may even be convicted by the state depending on the type of weapon)
Again and for the last time I invite anyone on this Forum to show me proof that this has in fact happened to any significant number of law abiding folks jus lawfully moving their firearms from one state to another. Otherwise it’s straight paranoia since I’m sure THOUSANDS of people every day move interstate with firearms with zero incidents, including me 3 times in the last year alone.
One of many sources to check. Pay close attention to his wording when talking about going through states in between origin and destination
The one behind the Elite section of USCCA membership has more detailed info and explicitly discusses the risk of felony arrest/prosecution even when federally covered.
