Can someone double check this for me please? The case is about military tribunals and trying Milligan (claiming to be a civilian) in a military court.

Yes. Perhaps it was a misunderstanding of what I was asking to look into
I was looking at the quoted statement. The passage shown refers to 50 states. In 1886 I believe there were only 34 states. It wasnt until 1959 that Hawaii became our 50th state.

thing is when a decision like that is made it applies everywhere to all states until that decision changes…
even those that joined later…
that’s how the Constitution works IIRC…
