Brandishing vs showing?

That is the de-escalation. I either stop him from shooting me or walk away or give him what he wants.

Seems to me he has already threatened you. First, he is robbing you of your wallet. Second, he has shown you a firearm. That says to me that if I don’t give him my wallet then he is willing to shoot me to get it. I wouldn’t attempt a de-escalation at all. He has already shown his intent.

The idea of “If I clear leather I pull the trigger” seems a bit extreme to me. Sure, the guy comes up on me, says give me your stuff and shows a weapon, I’m probably going to draw and acquire a target (his chest). IF he put’s his shirt back down, covering his piece I hope I wouldn’t pull the trigger, should he choose to grab the handle, I “Think” I’m going to stop that threat. But then again we need to remember, ALL of this happened in 1.6 seconds…

As for ‘OD’ and this Topic: If an axxhat starts trouble I will show him my Iron.
If he takes it further I will show him the Lead.
Showing him in the holster is not Brandishing It’s stopping the threat by being Pro reactive.
The look on your face should mirror your intent.

It is always a tough decision with the timeframe you have. You can move slower which gives the bad guy a chance but could save a life. Or you can move quickly to save your own when he didn’t really plan on drawing. The decisions can change according to context and none of those are easy. That is the biggest problem with self-defense. You may only get one chance to do it right. The answers of how to do it right may not be so clear.

Like beauty, it’s in the eye of the beholder. Some get triggered by pro-2A bumper stickers. If you are having a “lively discussion” with someone and a Leo shows up there is nothing stopping the other person from screaming “he’s got a gun.” This moves the attention away from the two of you all to you. By now you are probably face down on the pavement with a knee in the middle of your back. If its your lucky day you might not be in custody overnight. Deciding if you were brandishing will now be determined through the judicial system (even if you didn’t have a gun).

Some states use different terms: For instance, if you show your gun w/o clearing leather = Displaying ;
Pointing your gun at any one in a threatening way might be = brandishing in one state and = menacing of another;
firing a round up into the air = reckless endangerment; fire at someone = attempted murder. So, you have to keep your cool, and be sure that your are actions are justified by a real threat. Even if you are justified you may not be presumed justified until proven, esp. in blue city / state.

cause they often have a rather strange look in their eyes that make you question their sanity???

what is a reasonable person??? guess that also depends on your state???

That’s a tough question because there is no such thing as an average reasonable person or an average prudent person. That standard relies on the idea that every individual in every circumstance–both public and private–is always a rational actor, using reason and logic and factual evidence to make decisions. In other words, a figment of the imagination of the law and economists. The “reasonableness” of your actions will be determined by on scene LEO and investigators and prosecutors and defense attorneys and each of the jurors and the judge. AND they will each come up with a different idea of what’s reasonable.

It generally comes down to each person asking themselves “Would I have acted that way?” It’s a very slippery sort of concept that defies definition except in the b r o a d e s t terms.
