I probably should not say this… but some might not consider it an honor to be compared to Fauci.
I think Mike tied the legal end of things up in a neat, tidy bow. Well done Mike.
Regarding carrying in a gun-free zone, it’s something I try not to do. I can’t say I’ve never done it, but it’s extremely rare that I do. If I know I’m going into a GFZ, I typically leave my gun secure and bring my backup stuff … Sabre pepper spray, tactical knife, tactical pen. As good as firearm? Heck no. But better than nothing. Great post Tex. You ask some great questions.
W0w,I need to brush up on my laws…I recently purchased several masks to wear in the event of a SHTF scenario, I figured the masks added an element of being a badass that any perpetrators would definitely think twice before attempting an attack!!! They really are spooky, guess I wasted my money!!!..but I want so much to look badass!!!
Businesses here with no guns signs dont carry the force of law so if I ever defended myself in such an area, i would tell them I am aware of their policy however I must remain onsite for the police to arrive and properly perform my duties before leaving said property. Several employees in there gun free zone I frequent know it’s not enforceable by law and given such a situation, I would imagine, would be perfectly fine with you needing to perform your duties after such an incident before leaving the property in compliance of business rules to avoid trespassing charges.
As has been stated, it all depends on the circumstances of the situation - location and local laws being key.
But, isn’t it a fact that if you pull out a weapon in a gun free Zone you will either be arrested for violating the law or a policeman might just turn the other cheek. I think a minimum of confiscation of weapon, a fine with jail or just a fine. I would think that this is a homeland security jurosdiction…I am so glad I am a member. Not an attorney, just thinking thru this dilemma. If a judge was honest and he heard the circumstance don’t you think the judge might give a pass because of the heroic circumstance?
I see a huge difference between the ‘red light’ and the GUN.
As a retired LEO I cannot imagine ANY officer writing a ticket for the good citizen who put their ass on the line to ‘run a red light’ and save lives.
The “gun free zone” means it falls into the venue of the District Attorney, and the one in Erie County seems to be a head hunter and might very well hang you out to dry [ unless your black,he let the last one go scott free ].
My version is ,there is no such thing as a gun free zone = UNLESS it is so heavily guarded by well armed & VERY well trained men.
Example, was Kennedy or Reagan in area’s that were HEAVILY guarded by well armed men ?.
The answer is sad,but obvious.
IF you train HARD with your tools AND you train hard at the ability to really CCW ,then you can guess my answer.
There are a lot of what if scenarios you can throw out and the legal answer will always be “it depends.”
It depends on if the gun free zone is enforceable or not. It depends on the jurisdiction and the applicable laws. It depends on the outcome. It depends on the police officer(s) and prosecutors and prosecutorial discretion. If it goes to trial it will depend on the jury and maybe the judge.
Unless it is on federal grounds or involves a federal official, it will usually not implicate any federal agencies.
You must have gone to Catholic school.
He may not have but I did and our nuns used a rattan cane With a ferrule on the bottom. Sister Mary could wake the dead when she cracked a desk or draw blood from your knuckles.
I know, I know, different times. Nuns scared me more than the priests when it came to punishment at school. Yes I was a knucklehead.

Why, yes. Yes, I did. ![]()
Depends on what state you’re in. If you are someplace with common sense like Idaho or Wyoming, then you’re going to be haled as a hero. If you are in some Liberal scumhole like Maryland, California or New Jersey, you will be arrested and thrown in jail.
I always carry,as far as I am concerned the 2nd Amendment prevails over any locally made "gun free"zones.
If I have to use it I will and worry about consequences later.
Or even worse:Corrupticut.
Here in Corrupticut, the laws don’t matter,it would be up to the officer, prosecutor or judge.
In cases like these signs that are posted are NO WEAAPONS Allowed is a warning
to you that is armed with a weapon, FEDERALLY they are not enforced by legal means, but is a very Big Warning to you or others and you are told to leave their property. If you do not comply to the warning, you can and may face legal problems and be put in jail.
They congratulate you for doing such a fine job saving lives then… the political nut jobs put you in jail for having a gun in a “gun free” zone
Very true!, I can speculate that IF he never drew his gun and let hundreds of people die then it was discovered later that he had a weapon and did not do anything somehow, someway the headlines would get twisted because he did not help anyone and let them all die… in my opinion it’s a no win situation
Now a days you look badass by NOT wearing a mask.
This means so very much more each and every new day.
