The Aftermath: Peeping Tom Meets Armed Resident

Was the perp presenting the knife in an aggressive manner? Self defense. If he was making threats? Self defense. Was he giving up? Was he not using the knife? What was his response to the man confronting him?

What is one to do? Wait for the intruder to make it all the way inside prior to confronting him? Remember, we are dealing with seconds for the defender to make a decision. This is a hard one to answer as the home about which he is defending is not his own. One doesn’t know what the law is within those few seconds to make a decision.

In the U.S., a person is generally privileged to use deadly force if they reasonably believe it is necessary to prevent imminent death or serious injury to themselves or others. This justification is typically considered a last resort when no other options are available.

I try to apply the KISS principle (Keep It Simple Stupid)

If I can’t articulate the Imminent threat, I’m tossing the dice with the prosecutor and the jury!

If I were in this situation, I would have had no LEO involvement & taken the assailant to the train station just like a Dutton.

Tough one - My anger would send me outside to retaliate, but I know that would make me the aggressor in some eyes. Definitely make the 911 call. If you find yourself outside, upon hearing a noise and legitimately justified to investigate, remember: he verbally threatened to kill you, and you were legally assaulted. Above all, know the laws in the jurisdiction you find yourself in!
