OK the guy has every right in the world to defend against a sexual assault, but it is illegal in Utah to have a firearm when you are intoxicated. This looks to me like a couple of laws bumping heads.
Well i mean if its a self defense type situation, then they dont have a murder charge … so makes sense to me that theyd charge him with what they have on him… or am i misunderstanding something? Its almost 330am, very possible. Lol
You must be on the east coast. I am on the west coast and it is 6:30, you are not misunderstanding anything. Killing and murder both end in death are two different things.
In Utah you " possession of a firearm as a restricted person and drug possession with intent to distribute, both third-degree felonies," is a piling on tactic. Had there been no drugs present he literally would have been charged with nothing.
