Take the long route around Colorado. Gov. repeals state preemption

I’ve been to Colorado once in 1974 with my dad at the airport. I’m still trying to shake off the stomach of liberalism.

In this context Standing means that the person bringing the suit must have suffered harm because of the law. I think that means that you must live/work within the jurisdiction in order to “suffer harm”. If you aren’t within the jurisdiction the law doesn’t apply to you, therefore you wouldn’t have standing.

You MIGHT also establish standing by being a non-resident traveling through the jurisdiction and, for some reason, being arrested/charged under the local law. Maybe.

Not a lawyer.

I am going to try to keep this is plain English and avoid legalese.

Standing is one factor in determining a person’s right to make a legal claim or to seek judicial enforcement of a duty or a right. “To have standing … a plaintiff must show (1) that the challenged conduct has caused the plaintiff actual injury, and (2) that the interest sought to be protected is within the zone of interests meant to be regulated by the statutory or guarantee in question.” Black’s Law Dictionary 1442 (Bryan A. Garner ed., 8th Ed. West 1999).

In order to have standing to challenge a firearm law, you generally have to be arrested for violation of the law.

As for making a claim for violation of the Second Amendment, the only justiciable right that are currently protected the right to bear arms in self defense INSIDE THE HOME. This is the only right that has been established by SCOTUS in Heller and McDonald. We will hopefully seeing this extended to carrying outside the home in the relatively near future.

As for challenging multiple local jurisdictions, it would depend on the court system in the state. In Kentucky you would have to challenge the law in each judicial jurisdiction, such as city courts or county courts then follow the appeal process through the state to the states highest court and then possibly to SCOTUS.

With respect to the one state challenging the laws of another state, I cannot disagree that Texas’ election was not harmed by the GA, PA, MI or WI elections. The electorate of each of those states or the candidates running in each of the states are the obvious parties with standing to challenge the elections.

On a lighthearted note, if one must go through northwest Colorado, may I suggest, Shooter’s Grill, in Rifle, CO?

it also shows a local burger joint here open today but they went out of business a year ago. I tried to go on their website and did but most things on there are not functional. Someone bought their copywrite to their name and logo and sold a bunch of stuff.

Agree with Shamrock. Stay away from Denver, Ft. Collins and Boulder (aka “12 square miles surrounded by reality”) and you should be good. I live in Colorado and haven’t had any problems (and skirt these 3 towns/cities as much as possible)

A while back when Antifa was once again in town, whatever basement dweller who was managing their social media that month posted a thinly veiled threat to visit Rifle and target The Shooters Grill at closing time I believe. The photo taken inside of TSG about an hour before closing showed a couple dozen local folks, having dinner and planning to hang out after closing time, all happily exercising their constitutional right to open carry. There were no signs of Antifa after hours that evening

Colorado has never honored my California CCW permit since I obtained it in the early 2010s. Additionally, Colorado won’t issue me a permit, nor will honor any other non-resident permit I can obtain (I’ve OR, UT, AZ, FL). For that reason, I won’t go to Colorado until they change their laws about CCWs, or the courts force change in the 9th , or whatever (all of which are unlikely, and the majority of the SCOTUS seems incredibly sluggish to act on anything earth-shattering with the 2A), so that may be never.

Hard to blame CO for not reciprocating your CA license when CA won’t reciprocate the licenses of any other State resident or not;)

Congressional candidate Lauren Boebert grabbed national headlines Tuesday with a stunning Republican primary win over five-term Rep. Scott Tipton in Colorado’s 3rd Congressional District.

Years ago I noticed that the politicians were getting brave about becoming Colofornia and not acting in the best interest of working law abiding citizens. 2013 was the year that they criminalized private sales of firearms and put in a magazine capacity limit. Only the sheriffs in denver and boulder supported the magazine limit and all the others realized that there is no way to enforce them. That was about the time that they disconnected with us. I would write a letter that started with a question asking how a particular law would make us safer. The form letter that I got back always said “thank you for your input but I don’t agree” and the question was never answered. The red flag laws are an open violation of several constitutionally protected liberties and now pre-emption is gone based on hype about Boulders ban on modern sporting rifles, which would not stopped the shooting at the King Soopers store.
Many of us are looking for a “friendly” state to move to.

Here in Mississippi we have some of the most gun friendly and 2A friendly laws in the nation. We would welcome anyone as long as the libs don’t bring their politics with them.
