Not a lawyer so take my advice for what it is worth. I would think that in most States you would have the right to defend yourself and others from the clear and imminent threat of death or severe bodily harm presented by this driver. Perhaps not in a State with a duty to retreat??
The bigger issue is that firing on this homicidal individual in this dynamic situation with so many other innocent people around would make for a significantly increased chance of hitting an innocent bystander either with a miss or a deflected bullet off of the windshield. So you would have to decide if the legal/moral implications of that happening are worth taking the chance to stop them from killing more innocent people. Plus you then risk being mistaken for one of the attackers by other responders. Not an easy choice.
The Officer who did fire waited until the vehicle cleared the parade route and fired at the fleeing SUV. A person of interest in custody.

With my CCW permit, I would try to be careful and allow for the possibility that in cases like this, there could be a medical emergency.
The chasing cop quickly determined that there was malicious intent which made the timely arrest possible.

I saw it’s 5 deaths as of this morning. To @Jovan , yes you could fire if you were in danger. But, you are responsible for every round that leaves your gun. Firing at a moving vehicle, could result in a miss and/or ricochet, and hit some innocent bystanders in the crowd. If a speeding vehicle is heading towards me, I’m more likely to evade, than try to shoot the driver. Shooting the tires or radiator in this situation wouldn’t save you, if your in the path, so those would just be wasted bullets, and time you could be diving out of the way.
