Can A New ICE Memo Turbocharge Arrests And Pass Legal Muster?

A whistleblower group in January released an internal Immigration and Customs Enforcement (ICE) memo authorizing deportation officers to enter the homes of wanted illegal migrants without a judicial warrant, igniting Fourth Amendment concerns from Democrats and legal scholars. However, other legal experts say the administrative warrant that the memo is based off — Form I-205 — authorizes agents to take such action against foreign nationals who’ve already exhausted their due process rights.

From the explanation given in the story, seems reasonable to me.

A Form I-205 is a warrant of removal that allows for the arrest of a foreign national who’s already been issued a final order of deportation. However, it’s an administrative document that does not require a judge’s signature, just an immigration officer’s.

Before entering a home pursuant to a Form I-205 warrant, ICE agents must “knock and announce,” stating their identity and purpose, and then allow the individuals inside a reasonable amount of time to act lawfully, according to the memo. Should they refuse admittance, the ICE agents must only use a reasonable amount of force to enter the illegal migrant’s residence.

They got their government-issued good-bye, sounds like it’s time for them to leave.

Other attorneys who have been practicing immigration law for years say federal agents have actually been long granted this authority.

“The authority for immigration officers to effectuate warrantless arrests was created by Congress in 1952 as part of the Immigration and Nationality Act,” Matthew Kolken, a longtime immigration attorney, told the DCNF.

“The specific provision of law, 8 U.S.C. § 1357(a)(2), provides that a warrantless arrest is authorized when an immigration officer has reason to believe that an alien is in the United States in violation of law and is likely to escape before a warrant can be obtained for their arrest,” Kolken continued. “The law further requires that after arrest the alien shall be taken without unnecessary delay for examination before an officer of the Service having authority to examine aliens as to their right to enter or remain in the United States.”

Wow, we are watching the Federal Government telling us to not carry our firearms, removing citizens from their homes without warrants while using the equivalent of secret police, arresting journalists, encouraging citizens to spy on one another, consolidating power to one party rule and this guy is telling someone to get their money back. Nazi Germany did not come about over night, Hitler was not elected and death camps were opened the next day. The failure here is this guys understanding of how long it took from Hitler coming to power to what Germany became when they started moving illegal Jews into death camps.

Is there evidence the persons being removed are Citizens? Are there authentic News articles that we can look-up which state those important details about the persons being arrested?

There needs to be substantial evidence that they are not legal. Whether on not that is true we don’t know.

Totally agree, we need more information as it’s unclear at this point.

Are those US Citizens harboring illegals? I’m not versed in all of the various criminal laws as it relates to illegal immigration. However, it is my understanding “harboring an illegal immigrant” can be actioned by extenuating circumstances and warrantless by authorities but it is not via immigration law, but under criminal law.

I need more information, personally.

Yes, the democrats are in full retard mode right now. It is truly amazing what they are pushing through or trying to, such as a ban on gas-powered leaf blowers - that amazingly failed, but was pushed back to next year.

I own a gas blower and last year bought a battery-operated one to try out. The gas one is definitely better, but it is much louder. So, if you don’t really want to clear your lawn of leaves, the battery-operated one is good. If you actually want to clear your lawn, the gas-operated is far better. I went with one of the most powerful battery-operated leaf blowers. The gas one is just an average one.

Additionally, the demons believe in higher taxes - what a surprise, based on bills passed, even though we currently still have a $1 billion surplus, they want to tax us more. Oh, wait, they said they want to reduce the tax burden. How did I get this so wrong? Oh, wait, I didn’t.

Okay… how does not liking a particular, excuse me, peculiar, performer, mean that one cannot appreciate certain cuisines? I don’t care for Mariachi music, either, so I can’t like Mexican food, then? :rofl:

Personally, most Mexican restaurants suck, and I make it much better at home. Well, that goes for most other cuisines, too - home-cooked is far better.

It looks like she probably has more tatoos and piercings than money, so I likely will not be taking her advice. :rofl:
