Some things have to happen. First, the immunity granted to individual cops has to be revoked. They have to become personally responsible for gross errors like this. As a former Marine, I want to use stronger language than “errors” but this is a family oriented site, so I will stay with “errors.” Secondly, we have to eliminate “exigent circumstances” for authority to break down doors without absolute evidence of armed resistance. Thirdly, we have to eliminate after dark warrant service unless the confidential informant appears before a judge and swears upon oath and before official court reporter on the record as to the reasons set forth in the request for warrant. In the case of an officer of the law, the same procedure must be followed. It must be a formal hearing in open court but closed session. The affiant must take the witness stand, take the oath to testify to the truth under penalty of prosecution for perjury. A deputy district attorney must be present and must question the affiant as to the facts presented and the judge must state in open court on the record that he believes there is true and sufficient testimony to satisfy an after dark warrant and the reasons for his decision. I have sat in various judges chambers and watched warrants being executed with all the casualness of lighting a cigarette (back when everyone smoked in court) and especially in chambers. That B.S. must end. I believe our founding fathers would be aghast at the casualness with which warrants are issued these days. I am quite sure what happens is nothing like what they anticipated. They anticipated what would occur would be like what happened when the supposed Atlanta Bomber’s house was searched by the FBI because they alerted the media that a search warrant was to be executed. The FBI knocked on the door waited until Richard (como se llama) answers the door; asked him and his mother to step outside and asked them to take their dog out and then thoroughly searched the house without trashing it. He sued the media but I have always maintained the presence of massive media attention was responsible for the FBI serving the warrant the way our forefathers intended warrants to be served, not by swooping in like a bunch of home invaders, dressed in black, wearing masks and screaming at the tops of their lungs.
