We, may be talking past each other here so let me take another crack at it.
The military defended the US and allied nations in WWII. And man, I am absolutely in awe of that. Both my grandpas slugged it out in the Pacific theatre. Awful awful stuff they went through. They defended our country and thus our system of governance. That is what affects laws and the limits and parameters of our rights.
No one went to a general or an admiral to see if this action, or that legislation violates the 14th Amendment. Such questions are litigated up the chain to SCOTUS. The military and its actions are blind to all of this, and have no say (anymore than the rest of the voting public) in any of it. Each member of the military has his or her opinion about this issue or that issue. They can vote for people who will vote for the policies they champion. But the military isn’t responsible for rights per se. They defend the country, and that allows “we the people,” with the tools granted us by the Constitution and its amendments to constantly be working out the details of our rights.
