Yea Bobby Jean I haven’t had a drop in sum 40 years and will never either, nothing wrong with drinking if you can handle it but I can’t, I drink and I’m sober and like flipping a switch I’m totally blacked out and have to spend the whole next day or week apologizeing for what everyone said I did lol. And unfortunately I have that addictive gene and if I were to take one sip I would stay drunk till I died and it wouldn’t take very long I’m sure. The world doesn’t need me drinking believe me. Later Bro.

I’m not a lawyer and don’t give legal advice. You have to know your state laws on DUI. Some states like mine say if you refuse to take breathalyzer or give blood, the state will suspend your license for a year. Depending on your situation, personally I wouldn’t take the breathalyzer nor give blood. The cost of a lawyer is stupid expensive and the fines are as well. Not counting how much your car insurance will increase as well. Doing sobriety tests only ensures you are guilty and bad cops will ensure that you will fail the tests.

I would rather have my license revoked for a year than to be screwed in court and by the insurance companies later. To my thinking a revoked license on your record is better than a DUI.

I may be mistaken, but around here I think if you refuse a field breathalyzer test they can take blood after they get you in the jail cell.

Some states are like that. But how long would it be for them to get a qualified person to do the job? If they take too long you just might miss out on a DUI.

Edit: they would have to get a judge’s order to right? Taking even longer. Do what is best for you.

The advice on just letting your liscense go for a year sounds good to me but the laws differ from state to state and the one thing I’m 100% certain of is if it’s on your breath your taking the ride like they say.

Don’t drink, and drive, and avoid all that.

Especially if you carry concealed you can kiss your CCW permit good buy too, and constitutional carry as well.

And, getting stopped, and refusing to take a sobriety test as a reason for suspension, or revocation of you’re driver license is not kept secret from your insurance company,

They will cancel your policy.

Good luck on getting it reinstated after your license is restored.

It’s just not worth it.

What reason would that be? I refused but not found guilty of a DUI? Sounds like a good setup for a law suit. It would probably take years for you to win it if you do sue. IMO things like that should be kept private since I wasn’t found guilty of anything. But what should be and what are, are often not what is.

Your driver recorded with DMV is a public record.

DMV may actually notify your insurance company to turn a screw on you for refusing to cooperate thinking that you know better.

DMVs, and Insurance companies work together with each other better than you think.

They use each other to leverage you to their mutual benefit.

You are more their pawn than you realize.

What you think you should be able to get away with is not necessarily so.

You risk your reputation.

Demonstrating self control, and reliability is more important to keeping your driving, and gun privileges, and reasonable insurance premium rates than being caviler is.

It is too expensive to find out the hard way.

Before you find out how costly that is do some research, and find out how the insurance industry, and DMV work in your state vs. any assumptions you might have.

Might save yourself a lot of inconvenience, and money.

Which is why I said it should be private. It’s also plucked up that they work together like that. That creates a two tier legal system. One of which is without authority, almost a vigilante system.

In Utah there is an insurance database, the cops actually have access to it in there cop cars. It ties insurance to your license plate. They run your plate, No Insurance? They tow your car.

Insurance Verification

The law requires motorists to carry proof of insurance and present it to any law enforcement officer upon request. In addition, for several years, Utah has compared its motor vehicle registration file with a database of insurance policies written to Utah residents. When the computer program discovers a Utah-registered vehicle does not have a corresponding insurance policy, a letter is sent to the vehicle’s registered owner, requiring the owner to provide proof of insurance.

To William191…like you said what should be isn’t what is or something like that, Anything can happen, Mine was dropped to wreck less driving because of my Dad having connections and I paid 100$ fine and I thought that was it, well it wasn’t because a cpl days later two State Troopers beat on my door at my parents house ( I was 18 at the time) and said “ we would like to speak to Mark” and I’m like here I am and they proceeded to tell me they wanted my drivers license and I said “ no no you got it all wrong that got down to a wreck less driving!” And the trooper said “ No son you got it wrong because no matter what the charge got dropped to when you fail the breathalyzer the state takes your license for a year, so give it to me” And he said now we need your plate off your car to” and I said if you want it you take it off” and he looked at me like he wanted to kill me and he just walked off the porch and grabbed that liscense plate with his bare hands and ripped that thing off my car like it was held on with bread ties! and one year later to the day they called me and said come and get it…Needless to say I didn’t have any more run ins with a W.Va. State Trooper
