Federal Court Declares "Assault Weapon" and Magazine bans to be UNCONSTITUTIONAL

To an extent, we have to use the term when referring to laws that use the term. It’s a matter of context.

FWIW my preference is to say something like “assault weapons” or so-called assault weapons.

Did someone on this thread use that term?

It is in the title,

I suppose, but the technical definition is a weapon that can fire semi-auto AND change to full auto (AKA machine guns). The sheeple and anti-gun folks tack the label onto anything except a wheel gun. They don’t realize or care it is wrong. All they know it is a trigger for the lefties to “take action now and ban them”.

I think the way the title did it is perfect FWIW. “Assault weapon” and magazine bans, that’s what the law is called so to know what it’s referring to, kind of have to use the term.

Context is key.

Other than referring to silly unconstitutional laws, the term should never be used IMO. Even for a true assault rifle (which assault rifle is an actual thing, though an AR15 type isn’t one) it’s better to call it a machine gun IMO

This is just part of it. The fully automatic weapons are made to suppress fire and gain counterattack positions. You cannot teach people who do not want to be taught.

True. You can’t fix stupid.

I don’t even think “assault weapon” has a technical definition. Assault rifle may, intermediate cartridge chamber rifle, mag fed, not too big or heavy, and capable of select fire (not necessarily full auto, my understanding is burst fire may technically qualify? At any rate either burst or full auto are “machine guns” in the US anyway and thus not what any of this junk is about due to their existing ridiculously red tape and cost)

Definition of “Assault Weapon”: The “Trigger Finger” of criminals using them to commit crimes by illegally use of a firearm. Ban CRIMINAL ASSAULT WEAPON TRIGGER FINGERS of Felony Criminals! Remove “Assault Weapon” from the hands of criminals! :flushed:

Alleged assault weapon

It’s a constant fight, in a communist state, where the politicians who swore to uphold the constitution are constantly trying to destroy it. This is what I received yesterday afternoon, 5/4/2023 from the Illinois State Rifle Association.

The way I see it is there certainly are assault weapons. An AR15 that is bought by someone and put in the closet and never fired cannot constitute an assault weapon. If said AR15 is used to assault someone than it is definitely an assault weapon. A baseball bat is produced to hit a baseball, if it is used to assault someone, than it is definitely an assault weapon. so goes with a kitchen knife, a broomstick, a car, etc. etc. It just gets under my skin to hear anyone refer to an AR15 as an assault rifle. And the mag capacity limit, is just to insure that evil-minded people will not be at a disadvantage (or fair advantage) to law abiding citizens. But I seem to not realize that a mag limit will make lawless people voluntarily give up any mag over 10 rounds. After all the lawless are the only ones that follow laws ,right???

I don’t know that changing the definition of what an object is based on what a person does with it works that well.

For example, that is the exact argument that says an AR15 style firearm with a “pistol brace” is actually an illegal unregistered short barrel rifle when the user puts the brace on their shoulder and fires it like a rifle.

I don’t believe that what a person does with something fundamentally changes what that something is.

All the grammatical gymnastics aside, “Used to Assault”, That IS an Assault device.

To continue the grammatical gymnastics- I don’t see the media attaching the assault term to other tools used. It’s just nonsensical to say someone was killed with an assault knife, assault bat, assault car, etc.

Calling semiautomatic firearms assault weapons usually based on some irrelevant feature or color is just a clear attempt to demonize the weapon which takes the blame away from the human who is using whatever tool they choose to assault someone. Would be more accurate though almost as equally ridiculous sounding to say the crime was committed by an assault human.
