I have mixed feelings about firearm enhancements. Is someone who harms or murders someone with a gun more of a criminal than someone who harms or murders someone with a knife or a hammer? No one wants criminals using firearms but criminals don’t follow laws anyways no matter how many new ones you tack on.
And as @Alces_Americanus points out how is having the suddenly redefined wrong shaped piece of plastic on the end of your firearm worth almost 10 times more jail time than manslaughter??? These laws all seem far more targeted at preventing law abiding citizens from defending themselves than at getting actual violent criminals off the streets.
In the version of the story I read, the DA explained that the enhancement was already being challenged, and they feared it would take years to resolve this one question. In the meantime, the real trial would be delayed indefinitely, and the county would be wasting money trying to out-lawyer Baldwin’s attorneys. The decision to drop the enhancement charge probably makes sense, from that perspective.

It doesn’t appear that the N.M. District Attorney is the sharpest pencil in the box. The D.A. and her team will be lucky to get any conviction, beyond a slap on the wrist. She will tout any outcome as justice served and her voters will be satisfied.
Well she is a democrat
In this case the enhancement is unconstitutional as it was not in effect at the time of the crime. Laws cannot be predated. That said we will have to wait & see.
