That is CRAZY! I had a client once who was in an accident and she was given a ticket for running the red light. There were two problems with it. First, the officer did not see her run the light and in Kentucky, an officer cannot cite for a violation unless it is committed in his or her presence. The second problem was that the citing officer was with the VA police who patrol the VA hospital and this occurred on the city road. The VA police had authority to enforce federal law but were not recognized as Kentucky Peace Officers and had no authority to enforce Kentucky law

Did the court dismiss the case?

No, they did not. Unfortunately, my client agreed to stipulate to probable cause to have one of the charges dismissed before I was involved.
