Since the government lost this case, it will be interesting (in a horrifying way) to see whether the government uses its legal warchest of virtually unlimited taxpayer dollars to appeal the loss to the Supreme Court. Too bad government is not obligated to pay plaintiffs’ legal fees when it loses these cases.
