USCCA Community Giveaway Terms and Conditions

Delta Defense, LLC (“Delta”) administers the United States Concealed Carry Association, Inc. USCCA Community Giveaway (the “Campaign”) on behalf of the United States Concealed Carry Association, Inc. (“USCCA”) (“Delta and USCCA are collectively referred to herein as “USCCA”) under the following terms and conditions:

A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.

YOUR PARTICIPATION IN THE COMMUNITY “AR BUILD POLL”, CONSTITUTES ACCEPTANCE OF ALL OF THE FOLLOWING RULES, TERMS AND CONDITIONS (COLLECTIVELY, THE “RULES”).

  1. Eligibility: In order to be eligible to participate in the Campaign, you must meet the following requirements:
  • You must be over 18 years of age and a resident of the United States
  • Log in to the USCCA Community (with your USCCA Membership or USCCA Free account)
  • Cast a vote in the designated giveaway polls; one vote/entry per topic, there will be a total of five posts to vote on.

Incomplete/Non-Compliant Entries. Entries that are incomplete or do not adhere to the Rules set forth herein may be disqualified at the sole discretion of USCCA. If you use fraudulent methods or otherwise attempt to circumvent the Rules, your submission may be removed from eligibility at the sole discretion of USCCA.

Alternate Method of Entry (AMOE): To enter the Campaign without meeting the requirements above and 4.a. below, send an email to support@uscca.com with your complete name and telephone number in the body of the email, and “USCCA Community Giveaway AMOE” in the subject line of the email no later than the end of the Entry Period.

Employees of Delta Delta or the USCCA, their affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Campaign. The Campaign is subject to all applicable federal, state, and local laws and regulations, and is void where prohibited.

2. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the decisions of USCCA as final and binding as they relate to the content of this Campaign.

3. Entry Period: Entries will be accepted online starting on [3/2/2020], at 12:00 a.m. CT and ending on [3/6/2020], at 11:59 p.m. CT. This time period shall be referred to as the “Entry Period.”

4. How to Enter:

a. Entry through the USCCA Community: You may enter the Campaign via the USCCA Community by satisfying all of the following requirements:

  • You must log in to vote (with your USCCA Membership or USCCA Free account)
  • Every vote is an entry
  • You can vote once per post. There will be 5 posts total, one each day of the contest.

b. Alternate Method of Entry (AMOE): To enter the Campaign without meeting the requirements of Section 1. above and 4.a. below, send an email to support@uscca.com with your complete name and telephone number in the body of the email, and “USCCA Community Giveaway AMOE” in the subject line of the email no later than the end of the Entry Period.

c. Incomplete/Non-Compliant Entries. Entries that are incomplete or do not
adhere to the Rules or specifications set forth herein may be disqualified at the sole discretion of USCCA. If you use fraudulent methods or otherwise attempt to circumvent the Rules, your submission may be removed from eligibility at the sole discretion of USCCA.

5. Prizes: There will be 1 winner of the Campaign (the “Winner”). The Winner will receive a $1,500 Palmetto State Armory gift card. The total retail value of the Prize is $1,500. The Prize and any related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner. No substitution of Prize or transfer/assignment of Prize to others or request for the cash equivalent by the Winner is permitted. Acceptance of Prize constitutes permission for USCCA to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

6. Odds: The odds of winning depend on the number of eligible entries received.

7. Winner Selection and Notification: Following the conclusion of the Entry Period, USCCA will randomly select the potential Winner from all eligible entries received during the Entry Period on March 13th, 2020. The potential Winner will be notified using the same method he or she used to enter the Campaign (namely, through the USCCA Community for any potential Winner submitting an entry in accordance with Section 1.a. or 4.a. above, or via e-mail for any potential Winner submitting an entry in accordance with Section 1.c. or 4.b. above. If, despite reasonable efforts, the potential Winner does not respond within 48 hours of the first notification attempt, if the potential Winner does not meet the eligibility requirements of Section 1 above, or if a Prize or Prize notification is returned as unclaimed or undeliverable to such potential Winner, such potential Winner will forfeit the applicable Prize and an alternate Winner may be selected. If any potential Winner is found to be ineligible, or if he or she has not complied with these Rules or declines the applicable Prize for any reason prior to award, such potential Winner will be disqualified and an alternate Winner may be selected. USCCA may successively attempt to contact up to two (2) potential Winners in accordance with such procedure, and if there is still no confirmed Winner after such attempts have been made, the applicable Prize may go unawarded. Potential Winners must continue to comply with all terms and conditions of these Rules, and winning is contingent upon fulfilling all requirements set forth above.

8. Rights Granted by You: By entering this campaign, you understand and agree that USCCA, anyone acting on behalf of USCCA, and USCCA’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

9. Terms & Conditions: USCCA reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should a virus, bug, non-authorized human intervention, fraud, or other cause beyond USCCA’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. Should this occur, USCCA reserves the right to select a Winner from all eligible entries received prior to and/or after (if appropriate) the date on which USCCA terminates the Campaign. USCCA reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website or violates these Rules.

10. Limitation of Liability: By entering, you agree to release and hold harmless the USCCA Community, USCCA, and their respective subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Campaign and/or his/her acceptance, possession, use, or misuse of any Prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process; (v) electronic or human error in the administration of the Campaign or the processing of entries. Additionally, by entering, you agree to release and hold harmless USCCA and its respective subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, as a result of installation of the humidifier awarded as the Prize under this Campaign.

11. Disputes: THIS CAMPAIGN IS GOVERNED BY THE LAWS OF THE STATE OF WISCONSIN, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Campaign, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Washington County, Wisconsin having jurisdiction. Further, in any such dispute, under no circumstances shall you be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than your actual out-of-pocket expenses (i.e. costs associated with entering this Campaign). You further waive all rights to have damages multiplied or increased.

13. Sponsor: The Sponsor of the Campaign is USSCA.
